부동산중개업과 변호사의 직무범위

초록
오늘날 사회적 벌률관계가 복잡.다양해지고 전문화되는 경향이 있는 상황에서 이처럼 전문자격사 사이에 업무영역과 범위를 둘러싼 대립과 갈등이 심화되고 있다. 특히 개업공인중개사와 변호사 간에도 업무영역을 둘러싸고 양 업계가 실제 충돌한 여러 사례가 있었다. 이 연구에서는 개업공인중개사와 변호사의 업무영역을 중심으로 공인중개사법상 중개의 개념과 변호사법상 변호사의 직무범위를 비교 검토하면서 변호사의 직무범위에 있는 일반 법률사무소에 부동산 중개나 알선행위가 포함되는지 여부를 살펴보고 변호사의 부동산 중개 서비스 제공에 따른 공인중개사법상의 쟁점으로 첫째, 중개사무소 개설등록여부, 둘째, 중개를 '업'으로 행한다는 의미, 세째, 유사명칭 사용 여부, 네째, 중개대상물 의 표시.광고와 관련된 법리적 문제를 소위 "TRUST부동산" 사건을 중심으로 검토함으로써 전문자격사의 배타적 업무영역에 대한 재조정 논의와 부동산중개업에 대한 공정한 경쟁환경 조성을 위한 개선방안을 마련하는데 기여하고자 한다.
Abstract
This issue raises the question of what the relationship is between the concept of ‘legal services’ for the purpose of Paragraph 1 of Article 109 of Attorney-at-Law Act, ‘material detailing the cases that has been accepted’ for the purpose of Paragraph 1 of Article 89-4 of the act and the concept of ‘case’, ‘accepted case’ that are repeatedly used throughout the Attorney-at-Law Act. From a structural point of view, it would be fair to say that a ripe case is not necessary for ‘legal case’ or ‘legal service’ to develop. The Attorney-at-Law Act uses terms such as ‘case’, ‘accepted case’ with regards to ripe cases. The business of practicing licensed real estate agent and that of attorneys-at-law are very different. The former focuses on Licensed Real Estate Agents Act, which are assist and mediate so that legal acts such as transactions between the parties can be done easily. Thus they are regarded as de facto acts by the precedents and accepted theories. Meanwhile, attorney-at-law represent their clients in suit-related acts and claims for administrative measures and handle general legal affairs. The problem is that both practicing licensed real estate agent and attorney-at-law try to expand their business areas for various reasons including service expanding, in which case a clash is inevitable between their business areas. This study reviewed the attorneys in the “ Real Easte Trust” are neither professionally nor legally certified real estate agents, they are doing the real estate business using a similar name title that an ordinary real estate agency uses, Using such a similar name gets into troubles with the law
