중국 ‘해외비정부조직관리법’의 분석과 전망

초록
본 논문의 연구대상은 올해 1월 1일부터 시행되고 있는 중국의 ‘해외비정부조직관리법’이다. 먼저 본고는 해외비정부조직관리법의 주요 내용들에 대해 소개한다. 그리고 중국 정부가 해외비정부조직관리법을 제정한의도와 목적은 과연 무엇인지 4가지 사항을 통해 분석한다. 마지막으로해외비정부조직관리법의 실시가 중국 내 해외비정부조직과 로컬 비정부조직에게 미치게 될 영향과 결과는 어떠할지 전망해본다. 필자는 본 논문에서 해외비정부조직관리법은 일차적으로는 중국 내 해외비정부조직에 대한감독과 규제를 목표로 하지만 그와 함께 중국의 로컬 비정부조직 또한 동시적으로 겨냥하고 있다는 것, 그리고 양자를 분리시켜 해외비정부조직의로컬 비정부조직에 대한 영향력과 재정지원을 차단하는 것을 그 목적으로하고 있음을 밝히고 있다. 아울러 해외비정부조직관리법의 시행으로 중국내 해외비정부조직의 운영과 활동이 위축될 것이고, 그에 따라 중국의 로컬 비정부조직와 시민사회 역시 일정 정도 이상의 영향을 받게 될 것이라예측하고 있다.
Abstract
The object of this research is ‘China’s Law on the Management of Overseas NGOs’, which has been implemented since January 1, 2017. First, this paper examines major contents of ‘China’s Law on the Management of Overseas NGOs’. Secondly, this paper analyzes the Chinese government’s purpose and intention of the enactment of ‘China’s Law on the Management of Overseas NGOs’ through four points. Thirdly, this paper anticipates the impacts and consequences of implementing ‘China’s Law on the Management of Overseas NGOs’ to o verseas NGOs a nd local N GOs in C hina. T his paper insists that ‘China’s Law on the Management of Overseas NGOs’ primarily aims to supervise and regulate overseas NGOs in China, but also aims at the simultaneous targeting of local NGOs in China. In addition, this paper predicts that the implementation of ‘China’s Law on the Management of Overseas NGOs’ will shrink the operations and activities of overseas NGOs in China, thus the local NGOs and civil society of China will also be influenced by a certain degree.
