유신헌법의 성립에 관한 헌정사 검토

초록
유신헌법은 대한민국 헌정사상 최악의 헌법으로 비판받고 있음에도 불구하고 아직도 우리 사회에 그 영향력이 남아있음을 부인하기 어렵다. 이 글은 이러한 유신헌법의실체를 파악하는 데 조금이나마 도움이 될 수 있는 자료를 마련하려는 것을 목적으로, 1차적인 자료를 활용하여 유신헌법의 성립 배경과 과정을 재구성하고자 하였다. 이를 통해서 10월 유신은 안보와 통일의 선명한 대립 및 선거를 둘러싼 문제와 그간누적된 정치⋅사회⋅경제적 불만과 부조리 등이 서로 얽히고 설켜있는 상황에서 상당한 시간 비밀리에 준비되었다는 것을 분명하게 확인할 수 있었다. 비상계엄 아래에서 이루어진 유신헌법의 성립은 비상국무회의가 주도하였으며, 비상국무회의는 필요한 법령들을 스스로 제정하면서 합법성을 충족시키며 유신헌법의성립을 확정하였다. 유신헌법의 성립 과정은 곧 헌법이 파괴되는 과정과 다르지 않은 것이었으며, 하나의반면교사로서 시사하는 바가 크다. 또한 이러한 일이 상투적인 수법으로써 어렵지 않게정당화되었다는 사실도 결코 간과해서는 아니 될 부분이다.
Abstract
It is hard to deny that the Yushin Constitution ― which was established by a few bureaucrats of the Park Chunghee regime in 1972 ― still exerts a adverse influence on Korean society, though it has been criticized as the worst constitution in the constitutional history of Korea. In order to provide a material which can help to understand the characters of this Yushin Constitution, this paper is reconstructing the background and the process of the establishment of the Yushin Constitution by reviewing historical materials as much as possible. In brief, the Yushin Constitution was prepared in secret while the issues about the national security, unification, and the election dispute as well as political, social, and economic irregularities were intertwined. In addition, an emergency cabinet meeting (비상국무회의) took the lead in establishing the Yushin Constitution by legislating necessary ordinances for itself under martial law. The process of establishing the Yushin Constitution is identical with annihilating the constitution, and it should never be overlooked that this was justified not so difficultly.
