제19대 대통령선거 동물복지 공약에 대한 동물법적 평가와 향후 입법적 과제

2017년 제19대 대통령 선거에서는 유력 대선 후보들 모두 반려동물보호 정책을 포함한 다양한 동물복지공약을 내세웠다. 특히 반려동물과 함께 생활하는 사람들의 호응을 이끌어 낼 수 있는 반려동물 의료체계 개선안이나 동물학대금지 방안 등을 집중적으로 홍보하면서 선거운동을 진행하였다. 주요 후보들이 모두 동물복지공약을 내걸고 선거운동에 나서게 된 근저에는 민주주의 원리가 작동되고 있다. 우리 대한민국 헌법은 민주주의 원리를 헌법의 기본원리로 천명하고 있다. 민주주의는 국가마다 시대마다 다양한 형태로 실현되어 왔고, 그 기초가 되는 국민의 의사도 시대에 따라 변화되어 왔다. 국민의 동물에 대한 관념이 변화하고 동물보호를 국가 정책과 입법에 반영하여 줄 것을 바라는 국민의 수가 증가하면서 그들의 의사는 정치적으로 영향력을 갖기 시작하였다. 그들이 국가에게 동물보호와 관련된 책무를 다해 줄 것을 요청하는 것은 민주주의 원리상 당연한 것이고, 국가의 운영을 책임지겠다고 나선 대선 후보들은 이에 응할 수밖에 없다. 대선 후보들의 공약은 향후 우리나라 동물정책의 방향과 내용을 가늠해 볼 수 있다는 점뿐만 아니라, 이들이 대통령으로 당선되었을 경우 그의 공약이 우리나라의 동물복지정책의 골간이 될 가능성이 크다는 점에서 정책적으로, 법적으로 중요한 의미를 지닌다고 하겠다. 각 후보들은 반려동물복지와 관련된 여러 문제점과 개선방안에 대하여 언급하고 있고, 일부 후보는 반려동물뿐만 아니라 농장동물, 실험동물, 동물원동물 등의 문제로까지 관심을 확대하고 있다. 그리고 한 걸음 더 나아가 동물의 법적 지위를 물건에서 벗어날 수 있도록 민법 개정 등 입법적 개선방안도 언급하는 후보도 등장하였다. 이러한 점은 법적인 측면에서 동물복지와 관련된 다양한 쟁점을 폭넓게 논의할 수 있는 기초를 마련해 준다는 점에서 매우 긍정적으로 평가할 수 있다. 이 글에서는 각 후보의 동물복지공약에 대한 총평과 분야별 평가(동물복지의 수용 및 구체화, 동물의 법적지위와 관련된 입법적 변화 모색, 동물학대금지와 처벌 강화, 유기동물정책, 반려동물 의료체계, 반려동물 이외의 동물에 대한 대책, 동물행정조직 및 체계 등)를 통하여 향후 동물정책의 입법적 과제와 전망에 대하여 검토하고 있다.
Abstract
The 19th Korea Presidential Elections in South Korea took place May 9 in 2017. During the course of presidential election campaign, presidential candidates brought up a subject of various animal welfare. In this paper, I review a legal evaluation of animal welfare pledge in 19th Presidential Election, and then I try to find a future legislative tasks and a improvement of animal welfare legislation system in Korea. I analyze animal welfare pledge in 19th presidential election - acceptance and materialization of animal welfare, legislative change of animal’s legal position, prohibition and punishment of animal cruelty, protection of abandoned pets, medical treatment system of companion animal, animal welfare policy of non-companion animal(farmed animal, animals in research, zoo anima, wild animal), improvement of animal administrative organization. And I suggest improvement of animal welfare legislation in Korea. 「Animal Protection Act」 is the most important law in animal welfare administration. The purpose of this Act is to protect life, ensure safety, and promote welfare of animals by providing for matters necessary for the prevention of cruelty to animals and for the protection and appropriate management of animals, thereby develop national ethos, such as respect for the life of animals. But this act lack of concrete and actual regulations for animal welfare. Still leaves many issues to be to be solved. This paper aims to suggest a Future Legislative Tasks and a improvement of animal welfare legislation system, through a legal evaluation of animal welfare pledge of presidential candidates.
