인공지능 활용 법률정보서비스의 발전과 관련 쟁점

초록
새로운 4차 산업혁명에서는 가장 중요한 화두 중 하나는 인공지능(AI)이 되고 있다. 인공지능은 대체로 강한 인공지능과 약한 인공지능으로 나눈다. 약한 인공지능의 경우는 이미 여러 분야에서 활용되고 있으며 점차 강한 인공지능에 대한 연구가 심화되고 있다. 법률의 분야에 있어서도 이러한 상황은 이미 벌어지고 있는 현실이 되고 있으며 이미 존재하고 사용되고 있는 법률정보서비스에 덧붙여 인공지능을 활용한 새로운 법률서비스가 개발되고 있다. 현재는 주로 법률정보를 단순히 제공하거나 분류, 가공하여 좀 더 전문적인 법률보조를 하는 서비스가 주종을 이루고 있으나, 궁극적으로는 인공지능 법률정보서비스의 발전은 쟁점사안에 대해 공정하고 정확한 판단이 가능할 것이냐가 최종의 목표가 될 것이며 현재는 강한 인공지능까지 기술의 발전이 도달해야만 이루어 질 것이라고 사료된다. 또한 이러한 발전도상에서 법률 데이터 수집의 문제, 법적사안의 판단에 있어 이를 인정할 수 있을 것인가에 대한 문제 및 인공지능서비스가 변호사법에 저촉되지 않을까 하는 법적 쟁점이 해결되어야 할 것이다.
Abstract
One of the most important issues in the new industrial revolution is artificial intelligence (AI). Artificial intelligence is usually divided into strong artificial intelligence and weak artificial intelligence. The weak artificial intelligence has already been used in various fields, and the strong artificial intelligence is becoming increasingly intense. In the field of law, this situation is already becoming a reality and new legal services using artificial intelligence are being developed in addition to existing and used legal information services. Currently, it is mainly providing services that provide more specialized legal assistance by simply finding, sorting and processing legal information, but ultimately, the development of artificial intelligence legal information services will be finalized to ensure fair and accurate judgment on contentious issues, and the development of technology will only be achieved until the development of advanced technologies is reached. In addition, it is necessary to solve the problems of collecting legal data, whether it can be recognized in judging legal matters, and legal issues that artificial intelligence services will not be broken the law of attorney.
