혼인 안내 제도 도입을 위한 시론

Since the research results have announced that divorce is accompanied by tremendous social costs, various measures have taken into effect to reduce divorce in the USA. The introduction of the premarital education programs is a good example. The divorce rate is on the increase in South Korea as well, and, correspondingly, the cases are more often observed in which the welfare of children is infringed. Therefore in this paper I investigated whether it is necessary or helpful to force couples on completion of premarital education program by law in Korea, and if so, what kind of method can be adopted. Especially it should be noted that it is impossible to encourage a premarital education program in a way exempting marriage fees like some states in the USA, because the Korean Civil Act does not require a marriage license for the establishment of marriage, and the enforcement of the premarital education could infringe on the freedom to marry.
