효과적인 빈집 활용 정책수립의 법적 개선과제에 관한 연구

저출산･고령화와 저성장 기조가 지속되면서 빈집이 해마다 증가하고 있는데, 빈집은 범죄 및 화재예방을 위한 공공서비스 비용을 증가시켜 지방정부의 재정에 부담을 야기하여 빈집의 증가는 결과적으로 지역경제 성장에 큰 걸림돌 역할을 한다. 이 같은 빈집의 부정적인 영향들은 다른 나라들에서도 나타나고 있는 일반적 현상이다. 이러한 배경에서 본 연구에서는 빈집 정비의 필요성과 빈집 정비 및 활용에 관한 현재 우리나라의 정책현황을 선행연구와 참고 문헌연구를 통하여 살펴보았다. 또 빈집 정비 및 활용에 관한 미국, 영국, 일본의 사례분석을 통하여 빈집 정비의 원칙과 빈집 정비를 추진함에 있어서 반드시 고려해야할 핵심사항들을 살펴보았다. 분석결과 미국은 빈집에 의한 지역사회의 피해에 관한 실증적이고도 객관적인 연구사례가 축척하여 방치부동산등록조례 등 빈집문제에 관한 실행력 있는 정책을 운영 중에 있음을 확인하였다. 영국의 경우 빈집 문제에 관한 중앙정부의 주택 전략을 지방정부가 지역실정을 고려하여 수용함으로써 효과적인 빈집 정비 정책을 운영하고 있을 알 수 있었다. 일본의 경우 빈집의 처리에 관하여 구체적이고도 상세한 처리절차를 마련하여 빈집 소유자의 재산권에 관한 공적규제의 정당성을 확보하고 있음을 알 수 있었다. 이러한 해외사례의 교훈들을 바탕으로 우리나라 빈집 정책의 기본법인 빈집 및 소규모주택정비에 관한 특례법의 문제점을 보완하고 개선해 나가야 한다. 특히 본 연구에서는 이 특례법의 개선방안으로 첫째, 빈집의 정의를 현실에 맞게 좀 더 세분화하고, 둘째, 빈집정비사업에 소요되는 재원확보 방안을 현실성 있게 보완하고, 셋째, 빈집에 철거에 관하여 보다 상세한 처리절차를 마련하여 빈집 소유자의 재산권 보호의 문제발생을 사전에 예방함이 요구된다. 특히 이를 위해서는 앞으로 빈집에 의한 지역사회의 피해에 관한 실증적이고도 객관적인 연구사례의 축척이 병행되어야 한다.
Abstract
With the beginning of New Normal Era the increase of abandoned properties or vacant houses becomes new urban management tasks. Vacant houses create diverse problems for cities : they become breeding grounds for crime and generate a spiral of decline and disinvestment. To cope with these problems Act on Special Cases Concerning The Vacant Houses and Small House Maintenance was legislated in February of 2017 and will be enacted in February of 2018. However, there seems some problems and limits of the Act even though it has not operated in the field yet. For this reason this study reviews various policies concerning vacant house problems in aborad such as United States, England, and Japan. One of the findings from the review is that the local governments in the United States could run the Vacant Property Registration to handle the problems generated by vacant houses thank to the accumulated case studies about the issues of vacant houses. Another finding is that Japanese local governments implement very specific procedures for the demolition of vacant houses in order to secure the validity of public regulation over the private property. Based on these findings this study provides some practical suggestions for the establishment of the effective policy for the use of vacant houses throughout the application of the Act on Special Cases Concerning The Vacant Houses and Small House Maintenance. Finally this suggests some directions for the proper amendment of the Act and future research tasks.
