국민참여재판제도의 시행평가와 몇 가지 쟁점에 대한 개선방안

The article reviews the results of judicial citizens` participation system which enforces this system during four years and tasks in the future. 「Civil Participation in Criminal Trials Act」(the Act) has come to effect on Jan. 1. 2008. The Act introduced the new judicial citizens` participation system, and it is regarded as a drastic change of the korean judiciary system. The korean judicial citizens` participation system is somewhat a hybrid system between a pure jury system in common law countries and a continental mixed jury system. The current judicial citizens` participation system is a kind of pilot system, in order to determine which system is appropriate for the Korean culture and legal background. It is important that the extension of judicial citizens` participation system cases for the settlement of judicial citizens participation system. For the institutionalization of judicial citizens` participation system, it needs change of lawyer`s understanding of judicial citizens` participation system, accurate analysis and assessment of judicial burden, people`s understanding and advertising or education of judicial citizens` participation system
