정신질환의 산재인정과 개선방안 - 일본의 심리적 부하 인정기준과의 비교 검토-

최근 노동시장에서는 과도한 성과주의, 직장 내 괴롭힘, 일-가정 양립의 부담, 고용불안 등으로 인해 근로자의 스트레스가 증가하고 있다. 이에 따라 근로자의 정신건강이 보호되어 야 한다는 논의는 나타나고 지속적으로 나타나고 있으나, 적극적 예방 및 구제에 대한 대응 은 아직까지 미흡하다. 우리나라와 일본의 모두 근로자들의 정신질환, 자살에 대한 경제적 보상을 확대하기 위하 여 업무상 정신질환(일본의 심리적 부하)의 판단기준을 제⋅개정하면서, 이에 전체적인 산재 인정건수가 소폭 증가하고 있다. 그러나 법원에서 근로복지공단(일본의 노동기준감독서)의 산재불승인처분을 취소하는 판결이 늘어나고 있어, 산재신청 초기 단계에 업무상 정신질환을 인정받지 못하게 되어 피재근로자 측이 시간적⋅비용적인 어려움이 발생하고 있다. 본고에서는 우리나라에서 업무상 정신질환 판단에 활용하고 있는 근로복지공단의 ‘정신질 환 조사지침’과 같은 기능을 하고 있는 ‘심리적 부하의 판단기준’을 구체적으로 검토한다. 특히 심리적 부하 인정기준은 근로자가 겪은 업무상 사건과 업무외 사건으로 나누어 이를 각각 ‘강, 중, 하’로 점수화하고 최종 산재인정여부를 결정하는 방법으로서, 우리나라의 종합 적⋅서술식 판단기법과는 다소 차이가 있어 일본의 두 판단사례를 통하여 적용방법을 살펴 보고 ‘정신질환 조사지침’과 비교 검토를 해본다. 또한 일본과 우리나라에서 동일하게 나타 나는 ‘행정기관의 업무상 정신질환 산재불승인처분에 따른 법원의 취소판결’현상을 해결할 수 있는 방안으로 입증방법의 개선책과 규범적 판단을 강화할 수 있는 대안을 제시한다
Abstract
In the recent labor market, workers’ stress is increasing due to performance-based, workplace bullying, work-life balance compliance, employment Instability, etc. There is a consciousness that the mental health of workers should be protected, but aggressive prevention and liability against mental and physical damage is still insufficient. For these reasons, the government has enacted and amended the criteria for expanding Workers’ Compensation for mental illness and suicide among both Korean and Japanese workers. The total number of Workers’ Compensation has increased slightly. However, the number of judgments that cancels the dismissal of Worker’s Compensation by Industrial Insurance Offices in the courts is increasing. The reason for this is that there are many cases where compensation is not granted at the initial stage of the application for compensation for industrial accidents on mental illness and suicide. In this article, we will examine the criteria and procedures for mental illness in Japan, and examine judicial cases. Finally, we will examine suggestions and remedies for the judgment of mental illness in Korea.
