개인정보 보호를 위해 교통카드 통합정보시스템에 적용할 법률에 관한 연구-신설된 대중교통법 제10조의8 내지 제10조의10에 따른 교통카드데이터 수집 및 제공 과정에서 발생하는 정보주체의 동의에 관한 문제를 중심으로-

Revised Public Transportation Act obliges the Minister of Land, Infrastructure and Transport to collect the Transportation card data, and allows those who want to use the data to request the data to the Minister. Considering the hierarchical system of law on the protection of personal information, conflicts between the law are expected in the process of collecting and providing the data. Therefore, this study investigated the laws to be applied to the process of the collecting and providing. First, in order to determine the contents of the data, the status and the subject of collecting and providing the data are summarized. Then, I examined how the consent of the information subject change when the applicable laws are changed in the course of the information transfer from the Korea Smart Card Co., Ltd. to the person who wants to use the data. Finally, the laws to be applied for each situation were judged by considering the interpretation of each law and the nature of Transportation card data. I suggest that the result of this study should be reflected in the Guideline for managing Transportation card data so that the administrative office can refer to the above discussions.
