유언의 자유와 제한을 통해 본 유류분제도의 문제점과 그 개선방안

가족 공동체 일원들은 가장이 사망하더라도 최소한의 경제적 보호를 받을 수 있도록 상속제도를 갖추었고 따라서 농경사회인 조선시대에서 유류분제도 없이 자신들의 경제적 활동 무대를 보장을 받았다고 할 수 있다. 농경사회였던 구민법시대에서 유류분제도는 고려되지 않았다. 1977년 민법 개정은 법정상속인이 아닌 자에게도 피상속인은 상속을 할 수 있도록 유언의 자유를 향유할 수 있게 되었고 그 반사로 법정상속인들을 위한 유류분제도가 필요하게 되었다. 하지만 이 제도는 21세기부터 부정적인 모습을 표출시켰다. 고령화 사회의 진입으로 상속인들의 연령도 높아져 유류분제도의 부양적 기능이 상당부분 상실되었고, 산업사회의 진입으로 상속인들이 피상속인의 재산형성에 기여하는 경우도 상당부분 감소하였으며, 피상속인의 상속재산에 대한 상속인의 기대를 보장하여야 할 이유도 크지 않게 되었다. 본 논문은 오늘날 다양한 환경의 변화에 대하여 유류분제도가 어떻게 적응해야할지를 내재적 측면에서 검토하고 비교법적 시각을 통해 일정한 대안을 제시하였다. 특히 미국법은 새로운 시각을 보여주고 있다. 먼저 유류분권을 생존배우자에게 제한적으로 인정하며 유류분권도 혼인기간과 생존배우자의 재산크기에 따라 탄력적으로 운영되고 있다. 이는 이혼 시 재산을 분할하는 경우 공평의 원리에 따라 그 분할이 탄력적으로 운영되고 있는 것과 맥을 같이한다고 할 수 있다. 구체적으로 미국의 상속법은 유언의 자유가 최대한 보장 받을 수 있는 구조를 갖고 있다. 피상속인은 법정상속인을 상속인으로써 배제시킬 수 있는 대륙법에서 생각해 볼 수 없는 자유까지 인정되고 있다. 이를 ‘상속배제(disinheritance)’라고 부르는데 대륙법적 시각에서 이해되기 어려운 개념이다. 반사적으로 영미법에서 법정상속인에 대한 상속배제(disinheritance)를 통한 유언의 자유는 특정인들을 최소한 보호하려는 요구까지 무시할 수 없었다. 이러한 요구 유류분제도(elective share)를 통해 생존 배우자와 그리고 직계비속들이 상속에서 배제되지 않도록 표출되었다.
Abstract
Continental law and common law systems have a different point of view for the freedom of will. Continental law system including Korean law rather protects legal successors by limiting the freedom of will by decedent. Common law system rather focuses on enhancing the freedom of will by decedent. The elective share system of legal successors so called ‘legal reserve of inheritance’ may be an exemplary subject to witness the difference between continental law and common law systems. In continental law system, it is believed that the elective share system may provide a counterbalance to what the continental law system allows decedents to freely make wills. On the other hand, in common law system, freely making wills is guaranteed even with the disinheritance of legal successors. Ironically, both legal systems provide legally reserving inheritance to protect a certain group of successors from disinheritance. However, the scope of protection in both legal systems makes it totally different. In continental law countries, the scope of protection is limited to legal successors while it is limited to a surviving spouse in common law countries. The death of a spouse and the divorce of marriage have consequence to the distribution of marital property. How to distribute the marital property is supposed to be similar to the cases for the death of a spouse and the divorce of marriage. In both legal systems, the length of marriage plays an important role to distribute the marital property where a dissolution proceeding is pending. It is not meaningful in civil law countries where a probate proceeding is pending while the U.S. law makes it meaningful. Especially, Uniform Probate Code provides the elective share rate depending on the length of marriage. In the U.S., the elective share system differently protects only a surviving spouse while it does legal successors in civil law countries. I believe that the reasons why we keep running the elective share system are not effective today compared to when the elective share system was introduced. For example, it might help the legal successors to keep their livelihood even after the death of the decedent. They might expect to inherit the property from the family community. This article tries to show that they are no longer effective any more. That is why we are supposed to face reality and to accept a new aspect for elective share.
