주류면허 관련 행정법적 이슈들에 대한 법적 규율

The Korean Liquor Tax Act consists of mainly two parts. The one part is the provision of taxation requirements, tax rates etc. This part is part of the nature of pure tax laws. The other part is the provision of general administration related to alcohol taxes. This is not a character of tax law, but rather a character of administration law. Nevertheless, this part has been designated traditionally as part of the Liquor Tax Act in South Korea. From this situation arise various legal issues. This article covers three issues of them. The first is how to enforce the rules governing the administrative procedures associated with licensing. The key issue in this part is whether or not the administrative process law can be applied to these procedures. The second is whether the Act on Administrative Investigations can be applied to the investigation procedures related to the management of liquor licenses. The third is how to enforce the statutory discipline if it raises the Administrative adjudication regarding to the Administrative disposition occurring during this process. In conclusion, this thesis is more appropriate to ensure that The Administrative Procedures Act, The Administrative Investigation Act and The Administrative adjudication Act are applied to the disposition arrised during the management of liquor license.
