지능형 자율로봇에 대한 전자적 인격 부여 - EU 결의안을 중심으로 -

Robots may have 'electronic persons' status under future EU laws before long. The European Parliament has passed a resolution of Civil Law Rules on Robotics. In the resolution, the European Parliament recommends that "a specific legal status for robots in the long run" should be provided for "so that at least the most sophisticated autonomous robots could be established as having the status of electronic persons responsible for making good any damage they may cause, and possibly applying electronic personality to cases where robots make autonomous decisions or otherwise interact with third parties independently". The resolution contains recommendations on how robot liability could be addressed prior to any new 'electronic persons' status being established. And the resolution calls on the European Commission to put forward proposals for new EU legislation that addresses "legal questions related to the development and use of robotics and AI foreseeable in the next 10 to 15 years" This paper is kinds of a critical review on the resolution. The interaction between robots and human brings about new legal considerations in respect of the apportioning of risk and liability. This paper contains a consideration of the issues involved in robotics, provides legal analysis about definition of smart autonomous robots, matters of consciousness, matters of the role and application of Asimov’s Laws in robot and issues about liability in robotics.
