현행 개인정보보호법체계상 감독기구 법제정비방안에 관한 연구

2014년 용역업체의 파견직원이 1억여건의 개인정보를 유출한 사건 이후 금융지주회사법, 신용정보의 이용 및 보호에 관한 법률, 정보통신망 이용촉진 및 정보보호 등에 관한 법률, 개인정보보호법 등이 개정되었다. 지금까지 개인정보보호 관련 법률들의 정비방향과 내용을 정리하면 개인정보보호위원회의 기능을 강화하고, 개인정보 유출에 따른 피해구제 등 정보주체의 권리보호를 위한 내용을 구체화하는 등 긍정적인 내용들도 있다. 하지만 개인정보보호법체계상 많은 문제점들이 여전히 남아있다. 특히 일반법인 개인정보보호법 제정 이후 개인정보의 보호와 이용간 충돌, 개인정보보호 관련 정부부처내 이견 및 혼선, 감독기구인 개인정보보호위원회의 무기력함 등으로 인하여 개인정보보호법 적용과 관리감독 면에서 오히려 점점 더 많은 혼란이 나타나고 있는 느낌이다. 개인정보보호감독기구와 관련된 국제적 기준 등에 맞추어 개인정보보호를 통해 국민의 개인정보자기결정권, 사생활자유, 인간존엄을 보호하고자 대통령 직속의 독립기구로 개인정보보호위원회가 설치되었다. 하지만 현행 개인정보보호법상 개인정보 보호기구의 위상과 기능과 관련된 규정들은 많은 문제점을 갖고 있다. 법률에 규정되어 있는 내용들을 검토해 보면 국제적 기준이나 그동안 논의되었던 수준에 비하여 보호기구의 독립성과 권한 등이 부족하다. 이러한 위원회는 효율적인 개인정보보호를 위한 독립된 기구로서 충분한 역할을 하기 어렵다고 판단되며, 체계적이고 일관된 형태의 개인정보보호기구라고 보기 어려울 만큼 ‘타협의 산물’이라고 할 수 밖에 없는 모습을 지니고 있다. 이에 대한 체계화, 명확화, 재정비가 필요하다고 생각한다.
Abstract
By establishing personal information protection act, the perpetual dangers of personal information leaks will be decreased. So that it is expected that it could contribute to the steady development of personal information industry. Meanwhile, the status and the role of personal information protection commission amounted to nothing at all in the process of the personal information. Ultimately, personal information protection commission prescribed on a alternative lacks theses things like the independence and powers of personal information protection organization compared to international standards and earlier discussion at level in the meantime. I think that the commission according to the alternative in this situation is not only disorganized but also inconsistent. so that this commission will not do an adequate role as the independent organization. Therefore I think that the alternative of personal information protection act demands systematization, disambiguation and rearrangement.
