학도의용군 피해보상제도에 관한 헌법적 고찰

학도의용군이 17~18세의 어린 학생들로 이루어졌다는 점에서 군사 훈련을 통해 실전 배치를 감행했다는 것은 현대적 관점에서는 납득하기 어려운 매우 비인륜적인 행위로 여겨진다. 그러나 이러한 학도의용군들이 다시는 존재하지 않는 세상을 위하여 다시 한번 준엄하게 학도의용군의 역사적 의의를 검토하고 이를 평가할 필요성이 있으며 또한 피해보상적 측면에서도 소외되지 아니하도록 법적 보호를 받게 하여야할 것이다. 자발적이긴 하지만 학도의용군의 존재는 당시 전쟁이 얼마나 처참하고 힘든 상황이었는지를 보여주는 냉혹한 단면이기도 하다. 우리나라가 위기 상황에 직면하였을 때 일어나 힘을 모은 세력은 매우 다양하였으나 이러한 젊은 청춘이 희생되는 상황은 돌이켜 보는 것 자체가 무척이나 힘겹고 안타까운 일이다. 그러나 그럴수록 이들에 대한 역사적 가치를 되새기고 이들이 갖는 시대적 의미를 고찰하여 이 땅에 비극이 되풀이 되지 않도록 하여야 할 것이다. 이러한 비극 앞에 국가는 국가를 위한 희생 앞에 어떠한 보상을 통해 그 희생정신을 기리고 앞으로의 존립을 튼튼히 할 수 있을지를 고민하여 제도화해야 하는바, 이러한 국가유공자제도의 이념은 대한민국의 오늘은 온 국민의 애국정신을 바탕으로 전몰군경과 전상군경을 비롯한 국가유공자의 희생과 공헌 위에 이룩된 것이므로 이러한 희생과 공헌이 우리와 우리의 자손들에게 숭고한 애국정신의 귀감으로서 항구적으로 존중되고, 그 희생과 공헌의 정도에 상응하여 국가유공자와 그 유족의 영예로운 생활이 유지ㆍ보장되도록 실질적인 보상이 이루어질 것을 요구한다. 이러한 피해보상을 우리 헌법은 별도의 명문 규정으로 보장하고 있지 않으나, 국가배상제도를 통해 위법한 국가작용에 의하여 발생한 손해는 구제가 가능하도록 제도화되어 있다고 할 수 있다. 6.25 당시의 학도의용군의 사례를 넘어 언제든 발발할 수 있는 전쟁 상황이나, 국가를 위해 희생한 제대 군인의 재사회화를 위하여 보훈정책적 변화가 필요하다. 또한 현실적으로는 이러한 학도의용군 및 소년병을 희생한 작전 성공 방식은 도의적 비난을 받을지언정 준엄한 전시상황이었음을 감안할 때 국가 배상은 어렵다고 할지라도, 충분한 보상 제도를 통해 이들의 희생을 기릴 필요가 있다.
Abstract
The fact that the Student Volunteer Army was made up of young students aged 17 to 18, and that the military deployment of the military exercises was considered to be a very inhuman act that is difficult to understand from a modern point of view. However, for the world where this student volunteer army does not exist again, it is necessary to strictly review and evaluate the historical significance of the student volunteer army. Also, it should be protected from the alienation from the aspect of damages compensation. The existence of the student volunteer army, though voluntary, is a ruthless aspect of how horrible and difficult the war was at the time. When Korea faced a crisis situation, the forces that gathered power were very diverse. However, the situation in which young youth is sacrificed is very difficult and regrettable to look back on itself. As time goes on, the historical values of these people should be reconsidered and their meaning should be examined so that tragedy does not recur on this land. In front of this tragedy, the state should try to institutionalize the sacrifice in the way of sacrifice before the sacrifice for the nation and to wonder whether it will be able to survive for the future. These sacrifices and contributions will be enduringly respected to us and our descendants as the inspiration of the sublime patriotic spirit, and will be rewarded with substantial rewards to maintain and guarantee the honorary life of the country's benefactors and their bereaved families in accordance with their degree of sacrifice and contribution Demand. Although the Korea Constitution does not guarantee damage reword as a separate regulation, it can be said that the damage caused by illegal national action through the national compensation system is institutionalized to be able to relieve. Changes in veterans policy are necessary for the re-socialization of discharged soldiers sacrificed for the country. Also, in reality, the operational success at the expense of student volunteer army can be criticized morally. Of course, it will be difficult for the state to compensate, considering that it was a strict war situation. But there is a need to honor their sacrifice through legal indemnification.
