공동저당의 대위등기와 후순위저당권자의 대위-대법원 2015.3.20. 선고 2012다99341 판결-

초록
동일한 채권의 담보로 수개의 부동산에 저당권을 설정한 경우에 그 부동산의 경매대가를 동시에 배당하는 때에는 각 부동산의 경매대가에 비례하여 그 채권의 분담을 정하지만, 저당부동산중 일부의 경매대가를 먼저 배당하는 경우에는 그 대가에서 그 채권전부의 변제를 받을 수 있다. 이 경우에 그 경매한 부동산의 후순위저당권자는 선순위저당권자가 다른 부동산의 경매대가에서 변제를 받을 수 있는 금액의 한도에서 선순위자를 대위하여 저당권을 행사할 수 있다(민법 제368조 제1항 및 제2항). 후순위저당권자인 원고 甲이 선순위저당권자의 다른 부동산의 저당권에 관하여 대위등기를 하기 전에 그 저당부동산을 제3자에게 매도한 경우, 후순위저당권자인 원고 甲은 민법 제368조 제2항에 의한 대위를 주장할 수 없다는 대상판결은 그 논거와 결론 중 부적확한 일부 논거를 제외하고는 거래의 안전 등 결과적인 측면에서 타당하다고 생각한다. 한편, 법이론적인 측면에서 변제자대위의 경우 부기등기를 요구하는 민법 제482조 제2항 제1호와 같은 규정이 후순위저당권자의 대위의 경우에는 존재하지 않음에도 불구하고, 제3자에게 대항하기 위해서는 미리 대위등기를 하여야한다는 것은 부당한 점도 있다. 따라서 후순위저당권자의 대위의 제한과 후순위저당권자와 제3취득자 등 다른 권리자와의 충돌 등에 관하여 민법 제482조 제2항과 유사한 규정을 신설하여 이러한 부당한 점을 입법적으로 해결하는 것이 타당할 것이다.
Abstract
Civil Act Article 368 (1) Where two or more immovables are mortgaged to secure one claim and the proceeds of the auction are to be applied simultaneously to its satisfaction, the burdens in respect of the obligation shall be divided in proportion to the proceeds of the auction sale of each immovable. (2) If the proceeds of the auction sale of part of the immovables mentioned in the preceding paragraph are to be applied, the mortgagee may obtain full satisfaction of his claim out of the same; in such case the mortgagee next in priority may exercise the right of the prior mortgages by subrogation to the extent of the amount which the latter would have received out of other immovables in accordance with the provisions of the preceding paragraph. In connection with this provisions, the Supreme Court decision judges as follows. When mortgage property owner sells the real estate before the mortgagee next in priority registrates by subrogation on mortgage of the other real estate, mortgagee next in priority can’t argue the Civil Act 368 (2). This decision is correct except some basis of an argument.
