경찰 손실보상제도 운영실태와 개선방안

본 연구에서는 2014년 4월 6일부터 시행된 경찰관직무집행법상 손실보상제도에 대한 법・제도적 관점에서의 분석과 실제 실무상 손실보상 업무 처리에 대하여 검토・분석을 통한 개선방안 제시를 목적으로 한다. 이를 위해 제도 시행 후 1년간의 운영 실태를 실증적으로 분석한 바, 제도 운영에서의 절차적・실질적 문제점이 도출되었다. 우선, 청구권자의 절차적 권리 보장과 행정의 예측가능성을 확보하기 위해 보상급 지급 청구서 접수부터 손실보상심의위원회의 보상여부 결정의 통지까지 명시적인 처리기한을 규정할 필요가 있다. 손실보상청구와 관련하여 접수단계부터 결과통지 및 불복절차고지까지 각 단계별 처리기간을 명확히 하여 민원인들이 알 수 있도록 하여야 하고, 경찰민원사무편람에 손실보상처리와 관련된 사항을 포함시켜야 한다. 또한, 현행 경직법상 손실보상제도는 청구인의 손실보상청구에 대하여 최종 결정이 통보되기 전까지 청구인에게는 의견진술이나 협의의 기회가 보장되어 있지 않고, 처분에 대한 법적 쟁송이외에 재결 절차가 경찰청 차원에서 마련되어 있지 않다. 따라서 손실보상심의위원회의 일방적인 감액결정이나 기각결정 후 결과통보를 받은 청구인은 처분에 대한 법적 쟁송을 다툴 수 밖에 없다. 청구권자의 실질적 권익보호를 위해 최종 처분전에 의견제출의 기회를 보장해야 하고, 청구인과 경찰 양측의 소송으로 인한 재정적・시간적 낭비를 막고 통일적인 손실보상 심의를 위해 경찰청 단위의 재결청의 설치가 필요하다.
Abstract
The purpose of this study is to analyze the loss compensation system in the Act on the Performance of Duties by Police Officers enforced from April 6, 2014. After the examination of the management of the police compensation system after its implementation, several procedural and practical problems are drawn in the operation of the system. First, it is necessary to specify the explicit processing unit from the receipt of the compensation claim to the notification of the compensation decision to ensure the procedural rights of the claimant and the predictability of administration. In relation to the claim for loss compensation, it is necessary to clarify the period of each step from the reception to the result notification and the appeals proceedings, so that it can be seen by the complainants, and the matters related to the loss compensation should be included in the police civil affairs manual. In addition, the current system of police loss compensation does not guarantee the opinion of the claimant or the opportunity of consultation until the final decision and the procedure of the reevaluation is not prepared for the claimant. Therefore, it is necessary to ensure the opportunity to submit opinions before the final disposition to protect the actual rights of the claimant, and to establish a ruling authority of loss compensation in the Korea National Police Agency to prevent the waste of time and finances by both the claimant and the police.
