정보통신망법 해석에 관한 몇 가지 쟁점

This article deals with some issues about the interpretation of the Act on Information and Communications Network. This article can be divided into several parts as follows. At first, as an introduction, explains the purpose, necessity, strategy, method, and sequence of discussion of this article. Then, after examining the significance, structure, regulatory system, and normative characteristic of the Act on Information and Communications Network, this article explains the normative meanings of the provisions in Chapter VI of the Act thoroughly. Actually, those explanations constitute the core contents of this article. Such explanations mainly focus on the regulatory system of the Act, the authorities of the Ministry of Science, ICT and Future Planning and the Korean Internet & Security Agency to deal with intrusions into the information and communications network, proper meanings of the terms in the Act, which have been problematic when it comes to their meanings, like “providers of information and communications services”, “intrusions into the information and communications network”, and so on.
