이 논문에서는 통일 이후 북한 지역에 거주하는 주민들의 거주·이전의 자유를 제한하는 제도의 헌법적 정당성에 대하여 분석하였다. 먼저 우리 헌법상의 거주·이전의 자유와 일본, 미국, 독일에서의 거주·이전의 자유 논의를 살펴보았다. 또한 독일 주민들의 거주·이전의 자유를 제한하는 긴급수용법과 독일 외의 지역에서 거주하고 있었던 만기이주민들의 거주·이전의 자유를 제한하는 주거지정법을 제정한 사례가 있으므로 이를 살펴보았다. 다음으로 통일 이후 북한 지역 주민들이 남한으로 이주하는 경우의 문제점에 대하여 개략적으로 살펴보았다. 북한 지역 주민들의 이주 문제는 결국 남북한 경제통합의 문제로 귀결되고 막대한 통일비용을 야기할 우려가 있다. 이에 따라 통일 후 허가제를 통하여 북한 주민의 남한으로의 거주·이전을 직접 제한하는 것이 타당하다는 견해들이 주장되고 있다. 또한 경제적 유인을 통하여 북한 주민들이 북한 지역에 잔류하도록 하는 간접적 방식의 제한이 타당하다는 견해들도 있다. 위와 같은 논의들을 바탕으로 이 논문에서는 허가제로 북한 주민들의 남한으로의 거주·이전을 제한하는 제도는 과잉금지의 원칙에 위반되어 헌법상 거주·이전의 자유를 침해한다는 견해를 제시하였다. 또한 경제적 유인에 의한 간접적 방식으로 거주·이전의 자유를 제한하는 제도도 경우에 따라서는 과잉금지의 원칙에 위반될 염려가 있음을 지적하였다.
Abstract
The purpose of this paper is to analyze the constitutional justification of the system that restricts the freedom of movement and residence of North Koreans who continue to live in the northern half of the Korean Peninsula following unification. To do this, the paper first examines the freedom of movement and residence guaranteed in the Constitution of the Republic of Korea and the constitutions of other countries like Japan, the United States, and Germany. Next, this paper aims to broadly review the problems associated with North Korean residents moving to South Korea after unification, given that it ultimately boils down to concerns over economic integration between the two Koreas and enormous unification cost. Against this backdrop, one side argues the reasonability for introducing a permit system that restricts North Koreans from moving to and residing in the South after unification (direct method), while others opt for providing economic incentives to induce North Koreans to remain in the North (indirect method). It then examines Germany’s Emergency Accommodation Act (Notaufnahmegesetz), which restricts the freedom of movement and residence of the German people, the Act on the Residence Assignment Act (Wohnortzuweisungsgesetz), which restricts the freedom of movement and residence of German emigrants living abroad, and other acts of other countries like Japan, the United States. Based on the above discussions, this paper draws the conclusion that the direct method goes against the principle of proportionality, thereby infringing the freedom of movement and residence guaranteed in the Constitution, and that, in some cases, the indirect method may also transgress said principle.
