형사사법기관의 예산 비중 추세 분석에 관한 연구

초록
본 연구에서는 형사사법기관의 예산 추세를 분석한다. 경찰, 검찰, 교정, 보호, 형사법원등 전체 형사사법 기관을 대상으로 1994년 이후 2015년까지의 예산 추세를 살펴본다. 예산은정부 활동과 정책의 규모, 관심도 등을 실질적으로 반영하기 때문에, 이와 같이 형사사법 기관의예산 추세를 살펴보는 것은 해당 기관들이 지난 20여 년 동안 어떤 정책적 변화를 보여주고있는지의 추세를 1차적으로 판단할 수 있게 해준다. 경찰, 검찰, 교정, 보호, 형사법원 예산들의실질 예산 규모 추세, 국가 GDP 대비 각 부문별 예산 비중, 정부 예산 규모 대비 각 부문별예산 비중, 형사사법 기관 대비 각 부문별 예산 비중을 살펴본다. 분석 결과 형사사법에 대한 국가 예산은 증가하고 있다. 실질 예산을 기준으로 볼 때 형사사법예산은 증가하고 있고, 국가 GDP 기준으로도 더 높은 성장세를 보여주고 있다. 하지만 정부업무 비중 중심으로는 오히려 형사사법 예산이 낮아지고 있는 추세이다. 최소한 정부 업무 비중이 동일한 수준으로는 유지될 수 있도록 정책적 노력이 요구된다. 그리고 한국의 형사사법 예산에서는 각 사법 시스템 예산의 장기적인 변화 추세가 잘 보이지않는 한계가 있다. 한국의 경우 정권별로 각 형사사법 기관의 예산 증가와 감소에 차이가 발생한다. 즉 장기적인 복안으로 형사사법 시스템의 예산이 정해지는 것이 아니라 해당 정권의 지향점에 따라 예산이 변화하는 경향이 크다는 것을 의미한다. 보다 장기적인 전망을 가지고 형사사법시스템의 방향을 정하고 이를 추진하는 것이 요구된다.
Abstract
This study makes an analysis of Criminal Justices’ Budget Trend. There are Police, Prosecutor, Court, Correction and Probation in overall criminal justice organization. And this study analyze the budget trend among 1994-2015. By studying the budget trend of criminal justice organization, we would know about the organization’s change trend for about 20 years. We inspect the budget of Police, Prosecutor, Court, Correction and Probation, and the real expenditure budget of them. And we compare the each budget to the percentage of GDP, the percentage of Government Budget and the percentage of Criminal Justice System. The result is that the Government Budget of Criminal Justice has increased. Real expenditure for Criminal justice has increased, too. And the growth trend of Government Budget of Criminal Justice is higher than the growth rate of national GDP. But the growth trend of Government Budget of Criminal Justice is lower than the average growth rate of government budget. It is necessary to increase the growth rate of Government Budget of Criminal Justice according to the growth rate of Government Budget. And this study indicates that Korean Criminal Justice Budget has no long vision of the Criminal Justice System. The Korean Criminal Justice Budget is variable according to who rules the government. We should operate the criminal justice budget by long-term prospects
