여성임원할당제의 도입에 관한 연구

초록

여성임원할당제는 여성을 우대하고자 하는 제도가 아니다, 물론 일정한 비율의 여성임원을 채용하기 위해 기업들은 피고용인들 중 여성들에 대해서만 이전에 비해 더 많은 관심과 노력을 기울일지도 모른다. 하지만, 이러한 관심과 노력은 여성에 대한 우대가 아니라 당연히 사라져야 했던 이유 없는 차별을 해소해 가는 과정일 뿐이다. 현재 우리나라에서 여성의 사회진출을 지원하는 제도들은 기본적으로는 여성에게 고용의 기회를 확대하고 일・가정을 양립할 수 있게 지원하자는 목적에서 만들어졌기 때문에 여성의 고위직 진출을 뒷받침할 수 있는 것들은 아니다. 여성임원의 효과 내지 긍정적 측면에 대한 연구결과에서 알 수 있는 것처럼 임원의 구성이 다양해진다는 것은 다양한 의견이 이사회에 제시될 수 있다는 긍정적인 역할을 할 수 있을 것이다. 또한 여성임원할당제는 동일한 조건을 갖추고 있음에도 불구하고 여성이라는 이유로 고위직에 진출하지 못하는 여성들에 대한 이유 없는 차별을 개선하자는 것으로서 의무적인 고용을 위한 수단이 아니라 평등한 평가기준으로서 역할을 할 것이다. 다만, 즉시 일정한 비율의 여성임원을 강제하는 방식으로 도입되는 것은 어려울 것이며, 일정기간 기업들에게 자율적으로 여성임원의 비율을 확대하도록 한 후, 단계적으로 강제하고, 여성임원의 비율도 20% 내외를 시작으로 점차 확대하는 것이 필요할 것이다.

Abstract

Gender representation on corporate boards of directors refers to the proportion of men and women who occupy board member positions. To measure gender diversity on corporate boards, studies often use the percentage of women holding corporate board seats and the percentage of companies with at least one woman on their board. Globally, men occupy more board seats than women. Indeed, in 2015, women held 17.9% of the board seats on Fortune 1000 companies.[ Female representation at decision making level of corporations in Korea has been so low even though women account for half of college graduates and 40% of entry level employees. Given that gender diversity on boards is an issue rooted in the principle of equality of treatment, inequality in gender representation on boards can be combatted through equality of opportunity reforms or equality of outcome reforms. Governments and corporations have attempted to address the disproportionality of gender representation on corporate boards through both types of measures, including legislation mandating gender quotas (a reform based on the principle of equality of outcome) and comply or explain guidelines (a reform based on the principle of equality of opportunity). One approach taken by governments to achieve gender equality on corporate boards has been to enact legislation requiring a set quota of female representation on corporate boards. The quota system typifies an equality of outcome approach, which is concerned with the result rather than the means of achieving such a result. Belgium, France, Germany, Iceland, India, Israel, Italy, Norway and Spain currently have legislated quotas for women on corporate boards of publicly listed companies. A study on the 10 countries with gender quotas and 15 countries with comply and explain systems found that countries that adopt gender quotas tend to have several pre-conditions: female labor market and gendered welfare state provisions, left-leaning political government coalitions, and path dependent policy initiatives for gender equality, both in the public realm as well as in the corporate domain.
