이 글은 청년고용촉진특별법상 청년할당제와 관련하여 논의되고 있는 법적 쟁점을 살펴보고, 이 제도의 적용에 따른 위헌성과 관련한 문제를 비판적으로 검토한다. 청년할당제는 공공부문에서 일정 비율의 청년을 의무적으로 고용하도록 하는 제도이다. 그러나 이 제도는 일시적으로 청년실업 문제를 해소할 수 있으나, 문제의 근원적인 구조를 시정하는 것이 아니므로 궁극적 개선책이 되지 못한다. 무엇보다 제도 시행의 결과 다른 연령층의 기본권을 제한하게 되거나 또는 그들을 차별하게 되는 결과를 가져오는 내재적 한계를 안고 있다. 이로부터 청년할당제의 위헌성 시비는 계속 제기될 수밖에 없다. 따라서 동 제도는 현행법에 따라 한시적으로만 적용되도록 하는 것이 타당하다. 그러나 청년 미취업자의 고용촉진정책은 청년실업 문제에 대응하고 지속적이고 체계적으로 이루어질 필요가 있으므로 해당 법률은 상시법으로 전환하는 입법적 고려가 요청된다. 아울러 고용의 양적 확대 뿐 아니라 현행 일자리의 질적 개선을 통해 청년 고용이 촉진 내지 증대될 수 있도록 하는 정책적 접근도 함께 이루어져야 한다.
Abstract
This article studies on the legal issues surrounding the quota system of the youth under the Special Act on the Promotion of Youth Employment and reviews unconstitutionality of the system. The youth quota system is the compulsory scheme that public institutions should employ some young workers of fixed rate. But this is not fundamental solution because it could not correct the problem’s essential structure. Furthermore, as a result of applying the rule, it may violate the older’s basic rights or discriminate against such people. From that point, the youth quota system is implicit in the constitutional challenge. Ultimately, this article argues this system should be temporarily enforced as prescribed by law. However the Act needs to be transferred from the law with expiration date to the permanent law so that the youth employment promotion policies can be continuously and systematically implemented. In addition, the article suggests that the policy should be made to encourage young workers to increase employment through the quality improvement of current jobs as well as the quantitative growth of employment.
