There are two challenging tasks for companies looking to find new growth engines in the open innovation environment and for companies already holding them. In other words, how to protect core technology and secure new growth engine technology from the outside, the former is combined with the increase of manpower fluidity, and the latter is complicated with the difference in the patent law system and technology transfer regulation in each country. It is holding. This paper intensively examined issues to be considered in relation to the securing of technology and securing technology from the viewpoint of legal and institutional perspective. First, as a concrete method for protecting the technology, the business secret management system should be established based on the dual management system of organizational management to appropriately manage the trade secrets of the company and organizational management not to infringe the trade secrets of other companies Protection measures for business secrets of third parties, secret management measures for employees and retirees, and contracts for maintenance of confidentiality. As a protection measure during the research, we proposed the establishment of a research record maintenance system and a legal management system for contract implementation.
