This Article purports to find the most appropriate form of domestic sports arbitration institution by researching and comparing various types of sports arbitration institutions around the world. First it discusses the characteristics of sports arbitration and the necessity of establishing a sports arbitration institution. Then it analyzes the unsuccessful case of Korea Sports Arbitration Committee and reviews sports arbitration institutions from various countries, focusing on the form and basis of the institutions. With this, it suggests that the most appropriate form of sports arbitration institution in Korea is the “independent institution” model, and in order to successfully operate such domestic sports arbitration institution, proposes methods of increasing awareness of sports arbitration, strengthening cooperation among sports association, and advertising sports arbitration. The sports arbitration institution will also need to build a pool of arbitrators with expertise and ensure fairness in sports arbitration. Lastly, this Article discusses both the economic and noneconomic effect of an active sports arbitration and, in light of the current international trend of funding sports arbitration institution, puts forward the proposition that the newly established domestic sports arbitration institution will need full support from the government.
