자율주행차와 통상규범: 자율주행택시 도입의 한-미/한-EU FTA 서비스‧투자양허 합치성 분석을 중심으로

The main purpose of this study is to analyze the legal characteristics of autonomous vehicle which is now replacing the paradigm of obsolete car industry mainly based on internal combustion engines and is a key area of the fourth industrial revolution. On the basis of these legal characteristics, this paper looks into related domestic laws(specifically “law on passengers and land transportation”) and its relationship and consistency with international laws(especially “Korea-US FTA” and “Korea-EU FTA”). Since the provision of transportation services using autonomous vehicles has the characteristics of both taxi services and short-term vehicle leasing of rental services, it is of importance to properly and systematically respond to the oncoming international discussions or negotiations on how to classify transportation services using autonomous vehicles based on the analysis on aspects of and consistency among related laws. In order to scrutinize thoroughly, this paper concentrates on 1)the legal characteristics of transportation services using autonomous vehicles, 2)how to classify the transportation services using autonomous vehicles under domestic laws, and 3)the relationship and consistency between domestic laws and international laws(especially “Korea-US FTA” and “Korea-EU FTA”). Through this analysis, this paper draws an implication on how to respond to discussions or negotiations on the classification of transportation services using autonomous vehicles.
