법조윤리 확립 방안에 관한 시론

With the development of industry and the increase of the national income, the dependence of the people on the law is strengthened, but the trust of the people is lower relative to the law. There are still negative factors such as incompetence of incumbent judge and prosecutor, excessive number of cases of attorneys from all over the country, and overcharging of fees. While the lawyer's law has been amended to strengthen the autonomy of the lawyers' meeting, it has been working on self-regeneration through strengthening the registration examination for all lawyers who have resigned from the law, Is still insufficient. In this paper, I suggest some measures to strengthen the legal ethics by virtue of the first through sixth, focusing on the legal ethics declaration of the Legal Ethics Council. In particular, we have sought ways to secure the independence of judges and to reduce the number of the public in advance by improving the procedures for the appointment and promotion of judges as institutional improvements, expanding the system of public participation trials, the role of the Legal Ethics Council And the enactment of laws to expand its functions. It is time to systematize the necessary legal ethics for each profession, to expand the legal profession, and to emphasize legal ethics education in the era of full-fledged law school. We also suggested that the establishment of corruption system through analysis of big data such as SNS should be of interest to the prevention of legal misconduct and development of investigation technique.
