대법원 2013. 9. 26. 선고 2013도7718 판결은 관세법에 따른 통관검사절차에서 이루어지는 우편물의 개봉, 시료채취, 성분분석 등의 검사는 수출입물품에 대한 행정조사의 성격을 가지는 것으로서 영장주의 원칙이 적용되지 않는다고 판시한 바 있다. 대법원 2017. 7. 18. 선고 2014도8719 판결은 위 2013년의 판례 법리를 그대로 확인하면서, 일견 세관의 통관검사절차와 유사한 외양을 갖추었더라도 강제수사인 압수·수색에 해당하는 경우가 있다는 점을 밝히고 있다. 위 2017년 판례를 계기로 학계는 압수·수색과 행정조사를 구별하는 기준을 다시 한 번 확인하는 작업을 수행해야만 하는 과제를 안게 되었다. 종래 대법원의 입장을 체계적으로 고찰해 볼 때, 수사는 ① 수사기관이 ② 수사의 목적으로 ③ 행하는 활동이고, 수사기관의 주관적 혐의가 객관적으로 표현된 때 개시된 것이다. 이러한 실질적인 수사 개념을 적용하여 강제수사인 압수·수색과 행정조사를 구별할 수 있다. 대법원은 범죄의 인지 시점, 피의자신문조서 해당 여부, 임의동행과 강제연행의 구별, 임의제출물에 대한 영장 없는 압수의 적법성 등 다양한 사안에서 서류나 사안의 형식이나 외양이 아닌 그 실질을 판단하여 적용해야 할 형사소송법 규정 및 법리를 선택해오고 있다. 이러한 대법원의 입장을 ‘실질설’이라고 부를 수 있으며, 위 2017년 판례는 대법원이 실질설에 따라 압수·수색과 행정조사를 구별한 사례라는 의미를 지닌다.
Abstract
Supreme Court Decision 2013Do7718 Decided September 26, 2013 ruled that customs clearance inspection according to the customs law has the characteristic of administrative investigation, therefore search and seizure warrant was not necessary. Supreme Court 2014Do8719 Decided July 18, 2017. 7 confirmed the precedent of 2013Do7718 and newly raised the issue of difference between search and seizure and administrative investigations. The academic circles must carry out the task of confirming the criteria distinguishing seizure and search from administrative investigations. Systematically analyzing the position of the Supreme Court, investigations is the activity of the investigation agency for the purpose of investigation and it is initiated when subjective accusations of investigative authorities are expressed objectively. We can distinguish between search and seizure and administrative investigations by applying the material concept and criteria of the Supreme Court about investigations
