공정거래위원회의 조사절차 정비방안 ―적법절차의 강화와 강제조사권의 도입

공정거래위원회의 현장조사에 대해서 그 동안 기업들의 조사방해가 계속되어 왔고 이에 대해서 현실적인 대책이 별로 없다는 점이 지적되어 왔다. 이에 따라 이 글은 공정거래위원회에게 강제조사권, 즉 압수・수색 영장 신청권이 주어져야 한다는 주장을 개진하기 위해 쓰여졌다. 그러나 다른 한편 그동안 공정위의 조사과정에서 조사대상자의 진술거부권이나 영장주의와 같은 적법절차의 원칙이 지켜지지 않는다는 지적도 있어 왔다. 그러므로 강제조사권 도입 주장에 앞서 이를 둘러싼 논란, 특히 공정위의 조사에서 이와 같은 적법절차 원칙의 예외가 인정될 수 있는지를 살펴보았다. 구체적으로 진술거부권의 경우에는 법인에 대해, 그리고 ‘공적 기록 의무의 예외’ 법리에 따라, 또 영장주의의 경우에는 ‘광범하게 규제되는 산업’의 법리에 의해 각각 예외가 될 수 있다는 것을 설명하였다. 하지만 이와 같은 예외가 인정되지 않는 경우에는 진술거부권과 영장주의의 원칙이 지켜져야 할 것이므로, 이를 위한 공정거래법의 개정을 함께 제안하였다. 이와 함께 강제조사권의 도입을 위해서는 공정거래위원회의 일정한 조사공무원에게 특별사법경찰관의 지위를 부여하는 ‘사법경찰관리의 직무를 행할 자와 그 직무범위에 관한 법률’의 개정이 필요하다. 나아가 보다 근본적으로 공정거래위원회의 조사절차를 행정조사와 형사절차(혹은 범칙조사절차)로 이분화하는 방안을 검토하였다.
Abstract
This essay aims to propose a way to complement the Investigation Procedure of the Fair Trade Committee. It has two kinds of suggestions. The first one is to enforce the “Due Process of Law”, which means the guarantee both of the “Privilege against Self-Incrimination” and the “Principle of Warrant”. There can be some exceptions of these principles, however. That is, for the self-incrimination, the legal person cannot have the same right because it has the public duty to uncover its records, and for the Warrant Principle, “closely regulated industry” cannot call for the warrant for the seizure. The other one is to introduce the compulsory investigation of the Committee. To overcome the disturbance of the investigation by the corporation, the Committee should have the right to require the warrant and for this, some officers of the Committee are to be appointed as “Special Police”. Lastly and more fundamentally, this essay reviews the way to divide the committee’s investigation into the administrative one and the criminal procedure.
