지방규제개선을 위한 조례 정비방안에 관한 고찰

Since the regulations of local authorities are closely related with people’s daily lives, their improvement is urgent. It is able to promote local economy and increase the actual validity of such regulations by improving unfair regulations which have caused inconvenience or burden to people’s lives and local economy. To take care of the problems of local regulations by ordinance, in particular, there should be analysis on current autonomous laws and overall improvement of autonomous legislation. The improvement of the regulations which are inappropriate considering local conditions or those that can be obstacle in local economy should be accelerated, and there should be review on their legal legality and coherence, focusing on the regulations inhibiting local investments and those closely related with citizens’ daily lives. In other words, it is required to investigate current regulations under ordinance such as the regulations which can be a burden to people’s lives or local economy, those without statutory delegation and unrealistic/redundant ones. This study attempted to find a way to promote local economy and make a contribution to the development of local autonomy by driving an improvement method to have legal and valid ordinances, focusing on local authorities’ regulations by ordinance. The ordinance amendment plan would be applied to local authorities’ operation of ordinances and can be a turning point for autonomous laws to be upgraded according to the development of the local autonomy system. Furthermore, local authorities would search for autonomous legislation reflecting local conditions and uniqueness, and local autonomy would be upgraded accordingly, making a contribution to the improvement of overall autonomous legislation.
