위헌정당해산사유로서의 ‘민주적 기본질서’ ― 통합진보당과 독일국가민주당(NPD)의 강제해산사건을 중심으로 ―

2014년 통합진보당이 위헌정당으로 강제해산되고 재심신청도 헌법재판소에서 2016년에 각하된 이후, 2017년 1월 17일 독일연방헌법재판소가 독일국가민주당(Nationaldemokratische Partei Deutschlands, NPD) 사건에 대해 기각 결정을 내리자 통합진보당 사건이 다시 주목받고 있다. ‘신나치(neo-Nazi)’로 불리던 극우정당 NPD에 대한 위헌정당강제해산 청구사건을 3년 동안 심리해 온 독일연방헌법재판소는 “자유민주질서를 붕괴시키기 위해서는 체계적인 시도가 필요하고 위협이 임박했다는 신빙성이 충분해야 한다”며, “NPD가 위헌적 목표를 추구하고는 있지만 현재로써 그 목표를 성사시킬 수 있다는 구체적인 증거가 없다”며 기각했기 때문이다. 이 사건 이후 국내에서는 ‘(자유)민주적 기본질서 위배’라는 위헌적 목표와 활동내용이 동일한(했던) 한ㆍ독 두 나라의 두 정당에 대해 어떤 이유로 우리 헌법재판소는 강제해산결정을 하고 독일 연방헌법재판소는 기각결정을 했는지에 대해 주목하고 있다. 동시에 독일 연방의회가 최근 ‘독일의 존립을 위태롭게 하거나 자유민주적 기본질서에 적대적인 활동을 하는 정당에 대해서는 국고보조금을 중단’하기 위한 개헌(독일 헌법 제21조 제2항)을 본격적으로 추진하면서 위헌정당 여부가 확정되지 아니한 정당에 대해 국고지원을 중단할 수 있는 기준이 무엇인가에 대한 논의와 함께 투쟁적 민주주의에 대한 이론도 다시 주목받고 있다. 본 논문은 한국과 독일, 두 나라의 위헌정당 강제해산 사유인 ‘민주적 기본질서’라는 관점에서 2014년에 위헌정당 결정을 받아 해산된 통합진보당 사건과 올 초에 있었던 독일의 NPD 사건을 비교ㆍ검토해 보고자 한다. 이하 논의는 위헌정당 강제해산제도의 헌법적 의미와 역사를 먼저 살펴보고, 한독 두 나라의 위헌정당 강제해산의 헌법적 요건을 고찰한 후, 베니스위원회가 2000년에 발표한 ‘정당의 금지와 해산 및 유사 조치에 관한 가이드라인(Guidelines on Prohibition and Dissolution of Political Parties and Analogous Measures) 가운데 ‘민주적 헌법질서에 대한 위협(threat to democratic constitutional orders)’의 구체적 요건을 통합진보당과 NPD 사건에 적용해 봄으로써 두 나라의 헌법재판소 판결을 국제적 기준에서 비교ㆍ분석ㆍ검토해 본다.
Abstract
After The Unified Progressive Party(UPP) was forcibly dissolved for a reason of unconstitutionality by Korean Constitutional Court in 2014, UPP submitted Application for New Retrial, but it was finally dismissed in 2016 from the same Court. By the Way in 2017 Germany's Constitutional Court on the 17th of January rejected a request to outlaw the far-right National Democratic Party of Germany(NPD). According to the court, the party's purpose and activities ‘despised human dignity and was incompatible with the principle of democracy, to destroy the democratic order.’ Although recognizing that some party members might be engaged in criminal behavior, the court ruled that the NPD was not able to influence the German Parliament nor form coalitions in order to carry out its policies. To sum up, it said there was insufficient evidence that it could succeed, and that meant the party could not be banned. After the NPD Ruling, among the korean constitutional scholars many raised the question about the differences between the 2 cases(UPP and NPD) and the meaning of (free) ‘Democratic Basic Order’ theory. Despite of 2 parties’ constitution’s purpose and activities are same, UPP was forcibly dissolved but NPD was not. Furthermore, after the NPD ruling, the German Bundestag voted on the 22nd of June in this year(2017) passed the country’s constitution(§21⓶) to deprive anti-democratic political parties of federal money by majority of 502 of 579 delegates. “The state is under no obligation to finance enemies of democracy”, that is the reason of the german constitutional amendment. So ‘Militant Democracy’ theory is also disputing the inside and outside of the country. This paper reviews and analyses the 2 cases(UPP & NPD) focusing on the Guidelines on Prohibition and Dissolution of Political Parties and Analogous Measures of European Commission for Democracy through Law(Venice Commission), and then draws a Constitutional Justice as a conclusion from the international standard.
