사법개혁안으로서 사법평의회 방안의 위험성과 그 대안

국회 헌법개정특별위원회(위원장 이주영)의 자문위원회(사법부 분과)는 2017. 7. 24. 「헌법개정특별위원회 자문보고서(제2소위 사법부 분과)」(이하 “개헌자문보고서”)를 제출하고 사법개혁의 내용을 담은 개헌초안을 제시하였다. 그런데 위 개헌자문보고서는 매우 독특하고 급진적인 사법개혁의 내용을 담고 있다. 그 대표적인 것이 ‘사법평의회(司法評議會) 제도의 도입’이다. 이 사법평의회 구상은 현행 헌법 하에서 대법원장이 법관의 인사권을 비롯한 사법행정권을 독점함으로써 야기되는 문제들을 극복해야 한다는 의도에서 나온 것이다. 즉, 법원조직의 관료화와 법관의 서열화 문제, 전관예우 문제, 법관의 내부적 독립성 강화와 민주적 책임성 제고 등의 사법개혁 이슈들을 해결하기 위한 것이다. 이러한 문제의식에서 출발한 개헌자문보고서의 개헌안은 ‘사법평의회’라는 새로운 헌법기관을 신설하여 이 사법평의회가 대법관을 선출하는 권한, 대법관이 아닌 법관을 임명하는 권한, 법관에 대한 징계권(해임 포함) 등 모든 사법행정권을 행사하도록 하고 있다. 현재의 대법원장과 법원행정처가 가진 사법행정권을 모두 사법평의회에게 넘길 뿐만 아니라 심지어 규칙제정권까지 사법평의회가 갖는 것으로 되어 있다. 이 사법평의회 방안은 그 논거로 ‘사법의 독립성 확보’ 및 ‘법관에 대한 민주적 통제’라는 정당성을 제시하고 있다. 위 개헌자문보고서에 나타난 사법개혁의 문제의식에는 공감하는 측면이 있다. 그러나 ‘사법평의회 방안’은 문제를 푸는 옳은 답이라고 보기 어렵다. 오히려 더 나쁜 답으로 평가된다. 법관의 내부적 독립성 확보라는 취지에서 출발한 사법평의회 방안이 오히려 사법의 독립을 근본적으로 훼손하는 방향으로 설정된 것으로 판단된다. 결론적으로, ‘사법평의회 방안’은 한국 헌정사에서의 사법전통(司法傳統)과 현행 대통령제 권력구조를 전혀 고려하지 못한, 한국의 지난 수 십 년의 사법개혁 논의에서 거론조차 되지 않았던, 세계에서 유례(類例)를 찾아보기 힘든 ‘급진적이고 위험한 실험’이라고 평가된다. 이 글은 ‘사법평의회 방안’이 왜 급진적이고 위험한 실험인지를 논증하고, 나아가 헌법을 개정한다고 할 때 사법(司法)의 정치적 중립성과 법관의 내부적 독립을 함께 확보할 수 있는 헌법적 대안이 무엇인지를 제시하고자 하는 목적을 가진다. 이를 위해 우선 사법부의 구성원리를 법치국가적 독립성(independence)과 민주적 책임성(accountability)이라는 두 가지 헌법적 가치의 관점에서 해명하고(Ⅱ), 개헌자문보고서의 사법평의회 방안의 내용을 구체적으로 소개한 다음(Ⅲ), 그것이 갖는 위험성을 4가지 측면에서 논증한다(Ⅳ). 마지막으로, 사법의 독립성과 책임성을 강화하기 위한 헌법적 대안을 제시한다(Ⅴ).
Abstract
On December 29, 2016, the Korean National Assembly convened the Special Committee for Constitutional Amendment (Chairman Lee Joo-Young) within the National Assembly for the purpose of preparing an amendment bill to the Korean Constitution. The Special Committee has formed an advisory council composed of 53 experts in each field to collect consultation opinions. Thereafter, the Advisory Council held “Constitutional Amendment Debate for the Judiciary Trusted by the People” at the National Assembly to present a Constitutional Amendment Proposal for the Judiciary. And then, the Council submitted “The Advisory Report of the Special Committee for Constitutional Amendment”(hereinafter referred to as the “Advisory Report for Amendment”) on July 24, 2017. The Advisory Report for Amendment, however, contains very unique and radical judicial reforms. A major example is the introduction of the judicial council system. The idea of the judicial council is derived from the purpose of resolving some current judicial reform issues caused by the Supreme Court Chief Justice’s monopoly of the authority of judicial administration. In other words, it is aimed at solving judicial reform issues such as bureaucratization of court organization, ranking system of judges, some privileges for judge’s former post, strengthening internal independence of judges and improving judge’s democratic accountability. The Advisory Report for Amendment contains a plan to establish a new constitutional body called the “Judicial Council”, which shall have all the authority of judicial administration including personnel affairs such as the authority to elect the Supreme Court Justices, to appoint all judges except the Supreme Court Justices, and to discipline every judges. Furthermore, the new Council shall have the rule-making authority. The Report proposes the legitimacy of ‘ensuring the independence of the judiciary’ and ‘democratic control of judges’. There is a point of sympathy in the consciousness of judicial reform issues shown in the above Advisory Report. Under the current judicial system, It is problematic that the Chief Justice of the Supreme Court has the exclusive authority of judicial administration. It is reasonable to argue that this may undermine the internal independence of the judiciary. However, it is difficult to say that the judicial council plan is the right answer to solve the problem. It is rather a worse answer. The plan, which started from the intent of ensuring the internal independence of judges, seem to have been set in a way that fundamentally undermines the independence of the judiciary. In conclusion, the judicial council plan is evaluated as a radical and dangerous experiment that has never been considered in the discussion of judicial reform in Korea over the last few decades, not taking account of the judicial tradition in the Korean constitutional history and the current presidential system. This article argues why the judicial council plan is a radical and dangerous experiment, and when it comes to amending the Constitution, suggests a constitutional alternative to secure the political neutrality of the judiciary and internal independence of the judiciary. To this end, it first elucidate the constituting principle of the judiciary from the viewpoint of two constitutional values of judicial independence and democratic accountability (II). Then, the contents of the judicial council plan are introduced in detail (Ⅲ), and its risks are discussed in four aspects (Ⅳ). Finally, the paper proposes a constitutional alternative to strengthen the independence and accountability of the judiciary (Ⅴ).
