1980년대 가족법 개정 투쟁과 박완서의 소설: 박완서, 『그대 아직도 꿈꾸고 있는가』를 중심으로

Family Law, which includes domestic relations Law and succession Law has been revised 4 times since it was enacted. Above all, The third revision of the family Law in 1989, was dramatically passed through the unprecedentedly aggressive fight by the Female Union, which consisted of several different female organizations. It had been pretty big issue at the end of 1980’s, so a number of medias made special features aboutit. At this moment, Women News was published and started to discuss on “the capability of women as political position”, and Park Wan-suh’s Novel Are You Still Dreaming started to be serialized on this paper. Are You Still Dreaming, which has a story that Moon-kyung who was dumped by her lover and even almost lose the right for her baby had started to read lots of law books including compendium of laws and eventually achieved the victory at the court, is pretty impressive because almost no one wrote the stories about the struggle for revising Family Law at that period, even though the movement for revising Family Law was making a such huge impact on the society. This novel, differently from the political stream around 1989, tries to come into the ‘Law’ inside and be ‘intrinsic’ to the Law itself. In that point, it reminds us of the proper function of the literature which has to be preceded before ‘Law’. In this thesis, I am trying to read this novel which has been estimated as “a third rate drama about playing games between a man and woman, even though it has such a meaningful story as mentioned above. In other words, I am supposed to try to read Park Wan-suh’s novel as ‘the novel exceeding the Law’, which might cause a kind of disturbance to the ‘normal’ system of the law, by bringing the struggle for revising Family Law in 1980’s and Park Wan-suh’s novel Are You Still Dreaming together.
