우리나라 동물학대의 대응 및 한계 그리고 개선방안

초록
우리나라에서 동물에 대한 문제가 사회적으로 대두되기 시작된 계기는 인간이 기존 동물 에 대한 인식을 전환하게 되면서부터라고 할 수 있다. 즉 『시민법』상 동물은 단순한 물건 - 사적재산의 영역 - 으로 취급하게 되었지만 최근에는 이 개념을 탈피하여 동물은 우리 인간 과 함께 생활하는 반려동물 - 공감대상의 동물- 이라는 신조어가 탄생하게 되면서 기존의 『 시민법』상 동물에 대한 처우의 개선이 요구되었다. 왜냐하면 『시민법』상 동물학대는 타인에 의한 동물학대를 금지하도록 규정되어 있었기 때문에 동물소유주가 학대하는 경우에는 처벌 할 수 없었다. 이러한 한계를 극복하기 위해서 우리나라는 1991년 『동물보호법』을 제정⋅시행하여 기존 의 『시민법』상 동물학대를 금지하는데 일정한 한계를 극복할 수 있는 단초를 마련하였다. 하지만 이 『동물보호법』이 제정되어 시행된 후에도 동물소유자 등이 본인 소유의 동물을 학 대하게 되는 상황 속에서는 그들에게 동물학대에 관한 규정에 의한 처벌은 가능하게 되었지 만 그 학대받는 동물을 그 소유주 등으로부터 영구히 분리하는 데에는 한계가 있었다. 왜냐 하면 학대받은 동물을 그 동물소유주로부터 분리하는 행위는 동물 소유주 등의 소유권과 영 업의 자유가 상충되기 때문이다 . 따라서 이러한 한계를 극복하기 위해 『시민법』 및 『동물보호법』 규정의 문제점을 살펴보 고 그에 대한 개선방안을 제시할 필요가 있다고 본다.
Abstract
The issue of animal problems in our country began to rise socially is It is said that humans have changed their perception of existing animals. In other words, the animal law was treated as a mere article, but recently, the animal was born with a newly coined animal, and the newly created animal was required to improve the treatment of animals. Because animal abuse in Civil law prevented animal owners from abusing the animal because it prevents animal abuse by other animals. In order to overcome this limitation, the nation established a law protecting animal rights in 1991 to overcome certain limitations in preventing cruelty to animals in order to prevent cruelty to animals. However, if the animal rights law is enacted and animal owners abuse their own animals, it is impossible to punish animals for cruelty to animals, but it can permanently isolate the abused animal from its owner. This is because it conflicts with the owner’s rights and the freedom of business. Therefore, Civil law and Protection of Animal Act should be reviewed by the public for the sake of overcoming these limitations. And we need to look at the problem of the regulations and suggest improvements to them.
