비로스쿨의 법학교육과 학문후속세대 양성의 현황과 문제점

로스쿨제도의 도입에 따라 법학교육의 지형이 근본적으로 변화하고 있다. 전문・실무교육은 로스쿨에서, 이론・기초교육은 법학부에서 가르치는 이원적 체재로 운영될 것으로 예상되었지만 법학이론・기초교육에 대한 법학부의 역할은 흔들리고 있다. 오히려 로스쿨 체재의 출범과 동시에 학부의 법학교육은 그 존립의필요성에 대하여 부정적 인식을 받고 있으며 대학의 구조조정의 흐름에 따라 1차적 구조조정의 대상이 되어 학과폐지나 학생정원의 감축이라는 위험에 직면하고있어 점차 쇠퇴의 길을 걷고 있다. 로스쿨 출범이후 법학과와 학생의 수는 점차줄어들고 있다는 것은 통계적으로도 확인된다. 법학교육의 목적은 법학전공교육을 통하여 핵심역량을 기르며, 법률전문가라는직업기초능력을 함양하는 것에 그 주된 것으로 하며, 부수적으로 법학교양교육을통하여 변화하는 시대에 능동적으로 대처하기 위하여 비전공인을 대상으로 법학에 대한 교양교육을 부수적 목적으로 한다. 그런데 로스쿨의 교육목적은 ‘우수한법조인을 양성함’을 그 목적으로 하고 있다. ‘법률전문가’라는 사회적 직역이 반드시 변호사・판사・검사를 의미하는 ‘법조인’을 의미하는 것으로 볼 수 없다. 법학교육의 목표가 법조인과 같은 법률실무가 양성에만 있는 것이 아니라 법학이론전문가를 양성하는 것도 그 목표가 되어야 한다. 현재 학부법학교육에 대하여 로스쿨준비를 위한 예비교육기관이 될 것이라는장밋빛 전망이 있었다. 하지만 이것은 학부법학교육 혼자만의 희망에 불과했다. 학부법학교육은 생존을 위한 노력으로 변호사이외의 법률전문가 양성, 교양법학교육의 강화 등 다양한 활로를 개척하고 있지만 이 또한 용이하지 않다. 학문후속세대를 양성하는 임무에 대하여 로스쿨 또는 학부법학교육 어느 주체도 관심을 기울이지 못하고 있다. 로스쿨이 법률실무가를 양성하는 것에 중점을두고 변호사시험의 합격률을 증가시키는 것에 집중하는 사이에 법학학문후속세대양성기능을 어떻게 할 것인지에 대한 논의는 도외시되고 있다. 로스쿨이 아닌 대학에서 학문후속세대 양성기능을 담당하는 것은 현실적으로 어렵다. 비로스쿨은이제 법학교육에 있어서 사회적 약자에 속하고 있다. 그들이 구조조정의 압박에서벗어나 진정한 법학교육의 기초교육을 담당할 수 있도록 국가적・사회적 지원이필요한 시점이 되고 있다. 과거 공학의 위기, 인문학의 위기를 지나서 이제는 ‘법학(교육)의 위기’가 다가오고 있는 것은 분명한 사실이다.
Abstract
There is a pessimistic view that law education is dead since the law school system stay began. The law school system, which was launched in March 2009 is intended to overcome the exclusiveness of the previous law education based mainly on the judicial examination. However, since the introduction of the law school system and the lawyer qualification test, the present law school system has revealed problems. Statistics on education show that the status of the law department is falling. The College of Law is under constant pressure to restructure by the university authorities. Students want to go to law school or civil service examinations rather than as a scholar. The goal of educating future generations of scholars is a difficult task for the Faculty of Law. It is romantic for law school and non-law school to build a partnership structure for the post-disciplinary project. The primary role of the task is mainly in the law school, and the non-law school supported by it is rather realistic. Non-law school is now a social underdog in legal education. It is time that national and social support is needed so that they can get rid of the pressure of restructuring and take charge of basic education of true legal education. It is clear that the 'crisis of law (education)' is approaching now after the crisis of engineering and humanities in the past.
