A Study on Problems and Improvements of Jaebol Regulations in Monopoly Regulation Act

The Jaebols play a key role in the Korean economy and are contributing to economic concentration at various levels including market concentration, general concentration, and ownership concentration. The framework of the regulatory system has been maintained until now, after the introduction the provisions to put restraints on the economic concentration of jaebol by revision of Monopoly Regulations and Fair Trade Act(hereafter MRFTA) in 1986, Although there was considerable variation in the scope and extent of regulation. Although these regulations have been observed for a long time, the size of the Jaebol has grown, and the economic concentration has intensified, and It's hard to find a sign that this situation will be improved. It's impossible to solve these phenomena temporarily. But at least it is time for a systematic scheme to mitigate it, which will be a important tasks of newly launched government. All possible policies, including structural improvements, should be reviewed in terms of effectiveness and validity. In particular, strengthening Jaebol regulations from a behavioral perspectives is a viable option in the current legal system and should be pursued continuously. And a comprehensive approach to the small-medium sized business policy and the policy of Jaebol policies should also be positively considered.
