기간제법의 쟁점에 관한 제언

This study is about the Act on the Protection, etc. of Fixed-term and Part-time Workers that has been enforced for 10 years. There are several issues in this act, so this study intends to provoke discussion on those issues and to make several suggestion. Those issues are the validity of this act’s purposes, the conformity of this act’s purposes and this act’s each provisions, the definition of the term “part-time worker”, the insufficiency of types of discriminatory treatment provided in the act, the possibility of employing fixed-term workers without any restriction of reasons, the overtime work of part-time workers, the drawback of the prohibition of discriminatory treatment system and the operation of the monetary compensation system. The discussion on those issues in this paper would be only partly sufficient, so it will be a little guide aimed to amend and improve the Act on the Protection, etc. of Fixed-term and Part-time workers.
