피의자의 지문채취의 법적 쟁점과 개선방안

형사사법절차에서 범죄사실과 범인을 특정하고 확인하는 것은 매우 중요하다. 특히 범인(피의자)을 특정하는 건 가장 핵심절차에 속하고 그 방법도 다양하다. 피의자를 특정함에는 피의자의 지문을 채취하여 이를 확인하는 방법이 가장 손쉽다. 그리하여 매우 간편하면서도 인권 친화적이므로 현재 일반적으로 사용된다. 독일, 프랑스, 일본은 피의자의 지문채취를 형사소송법에서 직접 규정하고 있다. 하지만 우리나라는 형사소송법에 규정하고 있지 않고 형의 집행 및 수형자의 처우에 관한 법률, 형의 실효 등에 관한 법률에서 규정하고 있다. 이마저도 피의자의 지문채취와 관련한 규정은 법률에서 직접 규정하고 있지 않다. 피의자에 대한 지문채취의 필요성은 피의자의 특정과 확인, 피의자의 가담여부 확인, 범행의 상습성, 집행유예 결격, 누범 여부 확인, 책임요건(누범) 입증, 경합범의 확인 및 입증, 성명모용이나 대리출석, 기타 수사절차나 형의 집행 단계에서 신원확인, 양형자료 수집에 의하여 그 필요성이 인정된다. 수사절차에서 피의자에 대한 지문채취가 인간의 존엄성, 양심의 자유, 행복추구권, 신체의 자유, 신체를 훼손당하지 아니할 권리, 자기정보결정권, 자기부죄 금지의 원칙을 침해한다고 보기 어렵다. 피의자가 지문채취에 불응할 경우에 압수·수색·검증영장으로 지문을 강제로 채취하는 것이 가능하지만, 지문채취를 둘러싼 불필요한 논란을 불식시키기 위하여 형사소송법에 지문채취와 관련한 근거를 직접 마련하는 것이 필요하다.
Abstract
In a criminal procedure, it is important to determine and ascertain criminal facts and offenders. The determination of criminals (suspects), in particular, is diverse in method and comprises the core part of the criminal procedure. The easiest way to identify a suspect is through collecting and verifying the suspect’s fingerprints. This method is generally used owing to its simplicity and that it does not evade human rights. Countries like Germany, France, and Japan stipulate the collection of a suspect’s fingerprints under criminal procedure law. In the case of Korea, however, the fingerprint collection process is prescribed under the Administration and Treatment of Correctional Institution Inmates Act and the Act on the Lapse of Criminal Sentences but not directly stipulated under the Criminal Procedure Act. A suspect’s fingerprints need to be collected for the following purposes: (i) determine and identify a suspect; (ii) verify whether the suspect took part in the crime; (iii) determine whether the offense falls under a repeated crime; (iv) determine existence of reason for disqualification of suspended sentence; (v) prove requirements to impose criminal responsibility; (vi) verify and prove concurrent crimes; (vii) double check fake name or proxy attendance; (viii) identify the suspect in other investigation procedures or sentence execution process; and (ix) collect data for proper sentencing. Collecting a suspect’s fingerprint in an investigation process cannot be deemed as an infringement of human dignity, freedom of conscience, right to pursue one’s happiness, personal liberty, right not to have one’s body harmed, right to self-determination of personal information, or the principle of prohibition against self-incrimination. While it is possible to forcibly collect a suspect’s fingerprints through a warrant for seizure, seizure, and verification in case the suspect does not adhere to the fingerprint collection process, the legal basis related to fingerprint collection should be established under the Criminal Procedure Act so as to alleviate any unnecessary concerns surrounding fingerprint collection.
