외국인여성근로자의 노동과 보편적 권리 보장 - 우리 법제에 대한 비판적 접근 -

Korea introduced unskilled foreign workers to the country as a response to alleviate labor shortages in Korea’s 3D industries—a phenomenon brought on due to the country’s rapid economic growth, demand for globalization, and high educational attainment within society. Since then, foreign workers’ labor rights and human rights violation issues have been raised, and this has become a social issue with regards to the treatment of female migrant workers. Issues stem from problems of the legal system and problems of workers’ living and working conditions. In particular, these women are becoming the object of a ‘triple hardship’ as they are ‘women’, ‘foreigners’, and ‘workers’. In some cases, women have been neglected maternity protection, or subjected to sexual harassment and sexual violence. As well, long working hours and living in harsh environments leave them vulnerable to violation of the right to health. From the perspective of labor rights and human rights, this study examines the overall legal system as it pertains to female foreign workers, especially considering that women are subject to complex discrimination. All women have the right to freedom from sexual harassment and sexual violence, and the universal right to maternity protection.
