공무원책임 강화방안에 관한 연구 - 헌법, 형법, 국가공무원법을 중심으로 -

우리나라 헌법 제7조 제1항은 “공무원은 국민 전체에 대한 봉사자이며, 국민에 대하여 책임을 진다.”고 규정하고 있다. 그런데 우리는 하루가 멀다 하고, 언론 등을 통하여 공무원 비위사건을 접하고 있고, 이러한 비위사건은 끊이지 않고, 감소하는 경향도 아니다. 공무원은 이미 우리사회에서 부정부패, 제식구 감싸기, 권력굴종 등 부정적 이미지로 낙인되어 있고, 국민들이 용납할 수 있는 한계를 벗어나, 공무원은 이제 개혁의 대상이 되었다. 공무원들의 비위문제가 근절되지 않는 이유는 법, 제도가 없어서가 아니라 그 집행이 미진하기 때문이고, 책임규정이 약하기 때문이다. 따라서 헌법에서 규정하고 있는 공무원의 책임을 구체적으로 실현하기 위하여, 현행 우리 형법과 국가공무원법의 책임규정을 강화하여야 한다. 이에 형법에서 징역형만 규정되어 있는 ‘공무원 직무에 관한 죄’에 ‘벌금형’을 추가하는 방안을 제시하였고, 국가공무원법에서는 ‘피징계자의 신상공개’ 규정을 신설하는 방안을 제시하였다. 그러나 우리가 간과하지 말아야 할 것은 공무원의 비위문제는 공무원 개인의 문제만이 아니라는 점이다. 즉, 개인의 이익을 위하여 공무원을 비위에 휘말리기에 하는 경우 등, 사회 전반적으로 팽배해져 있는 낡은 관행도 공무원 비위에 영향을 끼치고 있다는 것이다. 따라서 공무원들이 국민에 대한 봉사자로서 책임을 다하기 위해서는 공무원을 포함한 모든 국민들이 법적의무는 물론 윤리적·도덕적 규범도 잘 지켜야 할 것이다.
Abstract
The article 7 of section 1 of Constitution of the Republic of Korea states, “All public officials shall be servants of the entire people and shall be responsible to the people.” However, there occur constant corruptions by public officials and they are reported almost daily in the press. Whenever public officials are mentioned in any corner of the press, it is prone to conjure up negative images upon officials bowing down to power or practicing corrupt. Now is the time for public officials to be reformed. The reason why corruptions by officials are not exterminated is that the corruption-regulating laws are not properly executed in reality despite their existence. Therefore, such laws which belong to the current Korean Criminal Law and the National Public Service Law must be strengthened in order to realize the responsibilities of public officials stated in Constitution. In this context, adding ‘penalty fines’ to the ‘crimes concerning the duties of public officials’ and ‘information disclosure’ to the National Public Service Law are presented as such alternatives. However, the crucial point we should not ignore is that the corruption of officials are not only their own problems, but also problems among our whole society such as private rent seeking. All of us as well as public officials should abide by laws and rules.
