국민참여감사제도의 현황과 과제
Current Status and Implications of Citizen Participatory Audit Programs in Korea

세계적으로 정부의 책임성이 강조됨에 따라 공공부분에 외부 이해관계인의 참여하는, 이른 바 민관협력이 가져오는 긍정적 효과가 주목되고 있다. 또한 유사한 관점에서 정부의 투명성이나 시민의 정책과정 참여가 시대적 어젠더로 자리 잡고 있다. 이러한 세계적 분위기에 따라 감사영역에도 감사과정이나 감사주체를 설정함에 있어서 시민의 참여나 협력을 보장하는 제도가 점차 도입되고 있다. 다만 제도의 유형별로는 차이를 나타내고 있다. 예컨대 우리나라와 같이 최고감사기구가 시민과 정보를 교환함으로써 서로 간의 협의가 가능한 유형이 있는가 하면, 필리핀과 같이 시민이 직접 최고감사기구의 감사과정에 참여하는 유형도 있다. 우리나라의 경우, 감사원은 감사영역에 시민의 참여를 보장함으로써 정부에 대한 국민적 신뢰를 확보하고자 1996년에 공익감사청구제도를 도입하였다. 이 제도의 골자는 19세 이상 300명 이상의 국민이나 시민단체 등 일정한 자격을 갖춘 자가 공익을 목적으로 특정사항에 대해 감사를 청구하도록 한다는 것이다. 나아가 2001년에는 「부패방지법」에 근거하여 공공기관의 사무처리가 법령위반 또는 부패행위로 인하여 공익을 현저히 해하는 경우, 19세 이상의 국민 300명 이상이 연서로 감사원에 감사를 청구하는 국민감사청구제도도 시행되었다. 다만 현행 국민참여감사제도는 감사 청구나 감사에 대한 의견 제시가 감사계획단계로 제한되고 있어 시민사회에 대한 최고감사기구의 상대적 우위를 전제하고 있다. 또한 시민참여감사제도의 일차적인 목적도 시민사회를 통해 감사에 대한 정보를 확보함으로써 감사의 전문성을 강화하는데 있는 것으로 보인다. 이는 국민참여감사제도의 활성화를 제약하는 여러 가지 제도적 요인으로 나타나고 있다. 예컨대 청구인의 범위 및 청구대상이 다소 제한되어 있다. 또한 공익감사청구의 경우에는 소송에 의한 불복이 허용되지 않음에도 불구하고 청구기간이 제한되고 있다. 나아가 감사원의 국민감사청구나 공익감사청구에 대한 처리와 관련하여 감사실시결정비율이 낮게 나타나고 있는데, 이에 대한 근본적인 진단도 필요하다. 끝으로 국민감사청구와 공익감사청구를 현재와 같이 이원화할 것인지, 아니면 양자를 제도적으로 통합할 것인지에 대해서도 진지한 고민이 있어야 할 것으로 보인다. 앞으로 이러한 요인들을 개선․보완한다면, 향후 우리나라의 시민참여감사제도 전망은 상당히 밝다고 생각한다.
Abstract
Supreme Audit Institutions(SAIs) promote transparency, effectiveness and accountability of the affairs of a nation to prevent corruption and incompetence. To this purpose, SAIs have increasingly adopted mechanisms to communicate and collaborate with civil society in the audit process. For example, Korea has made progress adopting institutional reforms that promote citizen participation. The operation of reforms that seek to participate citizens into fiscal policies and the audit process. In Philippines, citizens take part in joint decision in the process of audit. Several domestic and international factors, such as SAI institutional leadership, civil society capacity and international assistances have a strong influence on a Citizen Participatory Audit Program. Korea’s Board of Audit and Inspection(BAI) has developed two main Citizen Participatory Audit Programs at the audit planning stage. The BAI introduced the Audit Request for Public Interests(ARPI) in 1996 by the BAI’s internal regulations. ARPI allows groups or Civil Society Organizations to submit audit requests that supported by 300 formally identified citizens on specific issues for the public good. Also, The Anti-Corruption Act of 2001 established a legal basis for Citizen Audit Request(CAR). The two programs are much alike, but ARPI is much broader than CAR in terms of eligibility of requesters, audit scope, and time limit for reporting an audit result. The BAI is drawing upon citizen and Civil Society Organizations experts in its two main Citizen Participatory Audit Programs. Consequently, the BAI is more easily identifying areas of incompetence and corruption, produce information on government performance that bound up with reality of society, and overcome its institutional barriers. However, there is some room for improvement in ARPI and CAR more elaborately.
