공공기관의 노정교섭 및 정책협의 제도화 방안

공공기관 노사관계는 분권화된 기업별 노조체제와 정부의 노동배제를 특징으로 하고 있다. 이에 따라 공공기관의 단체교섭은 정부의 일방적 임금결정과 경영방침을 전달하는 수준에 머물러 있다. 따라서 이 글의 목적은 크게 다음 두 가지 점에 있다. 첫째, 공공기관 노사관계에서 노동의 배제를 극복하는 수단으로 노정 사이의 정책 협의와 노사 간 집단교섭을 제안한다. 둘째, 노동조합의 실질적인 참가를 실현시킬 수 있는 법·제도적 조건을 검토한다. 이를 위해 이 글은 공공기관 노조들이 노정 사이의 직접교섭이 가능한가라는 질문에서 시작하였다. 결론은 노동조합과 정부 사이의 직접교섭은 현재 조건하에서 가능하지 않다는 점이다. 그 대안으로 노동조합과 정부가 ‘공공기관 사회적 대화기구’내에서 정책협의를 진행하는 방안을 제안하였다. 요컨대 공공기관 사회적 대화기구 구성을 통해 정책협의를 예산 및 공공기관 운영 및 주요 정책과 관련한 사항에 한정하고 일반적인 단체교섭사항인 근로조건과 확정된 임금의 배분방식 등을 논의하는 공공기관 단체교섭의 틀로서 업종차원의 집단교섭과 기업차원의 보충교섭을 중층적으로 배치한 공공기관의 단체교섭 모델이 그것이다. 또한 공공기관 집단교섭을 수행하기 위해서는 사용자단체의 구성과 협의 및 교섭의 과정에서 대표성과 이행능력을 확보하기 위한 노동조합의 통합과 산별화가 주요한 과제로 제시되고 있다.
Abstract
Public-sector industrial relations are characterized by decentralized corporate unionism and labor exclusion from policy decision making and/or determining annual wage increase rate. As a result, collective bargaining of public institutions remains at the level of channelling government unilateral wage decisions and management policies. Therefore, the purpose of this article is largely in the following two points. First, it proposes policy concertation between public corporate unions and the government and sectoral collective bargaining between public unions and public corporate employers as a means to overcome the labor exclusion in the public sector industrial relations. Second, the institutional conditions for realizing the participation of public unions will be examined. In short, it proposes the combination of policy concertation at national level, sectoral bargaining and supplemental bargaining at the enterprise level. Especially, in order to carry out sectoral collective bargaining, both association of public agency employers and industrial unionization of public unions are required.
