국군체육부대 선수도태 결정과 행정법상 처분개념의 고찰

초록
체육특기자 중 남자선수들의 경우 국방의 의무를 이행해야 되기 때문에 20대 초반에 이르면 경력이 단절될 수도 있는 상황에 직면하게 된다. 경기력 발달에 가장 중요한 20대 초반의 시기에 체계적인 훈련 및 경기 출전 기회가 단절되면, 향후 운동선수로서의 경력에 막대한 지장을 초래하게 된다. 물론 우수한 기량을 가진 운동선수의 경우 병역특례제도나 국군체육부대, 경찰체육단 등을 통한 병역의무를 이행함으로써 운동선수로서의 경력과 훈련을 이어갈 수 있다. 행정법상 처분개념과 관련하여 일원설(실체법상 처분개념설)과 이원설(쟁송법상 처분개념설)의 논의가 있으나, 법원은 원칙상 일원설에 입각하여 행정행위를 항고소송의 주된 대상으로 보면서도, 예외적으로 행정행위가 아닌 공권력 행사에도 항고소송의 대상이 될 수 있는 여지를 남겨 두고 있는 것으로 판단된다. 하급심 판결이기는 하나 기존에 보직이동조치로 인식하던 국군체육부대 선수도태결정의 처분성을 인정하는 판결이 나왔다. 이러한 선수도태결정은 국군체육부대에 소속되어 운동선수로 복무할 수 있는 기회를 상실케 하는 가장 무거운 처분이며 당사자에게 미치는 불이익도 심대한 만큼 인사소청 및 행정소송에 있어 처분성을 인정하여 판단하여야 할 것이다. 아울러 체육요원 병역특례제도 확대, 국군체육부대, 경찰청․해양경찰청 체육단 확대, 입영연기제도의 현실화, 맞춤특기병 운동병과 신설 및 사회복무요원의 실업팀 근무 등 체육특기자의 경력 단절 예방을 위한 군복무제도 개선방안도 함께 연구되어야 할 것이다.
Abstract
Every masculine gender of the Republic of Korea shall faithfully perform mandatory military service. Unless otherwise prescribed in Military Service Act, no special exception to mandatory military service shall be prescribed. * Ph.D., Gyeongsang National University College of Law Assistant Prof. The Commissioner of the Military Manpower Administration may transfer persons recommended as persons with specialty in the field of arts or sports who are prescribed by Presidential Decree. Art and Sports Personnel means persons with special skills in the field of arts or sports who are assigned pursuant to Article 33-7 in Military Service Act and perform duties in the field of arts or sports to promote culture and enhance national prestige. There is a decision of Player falling behind in Korea Armed Forces Athletic Corps. It is the most severe disadvantage to the Player. so it should be included in the Definitions of Disposition. "Disposition, etc." means the exercise of or refusal to exercise public authority by an administrative agency as function of law enforcement in relation to a specific fact, other similar administrative actions in Administrative Litigation Act. The court made the decision to include Player falling behind in Disposition. therefore This judgment protect Players from the infringement of their rights or interests in Korea Armed Forces Athletic Corps. In addition, Improvement of Military Service should be studied to prevent career breaks in Sports Personnel.
