행정상 제재처분의 제척기간ㆍ시효와 그 법리에 관한 소고

초록
현행법에서는 의무위반에 대하여 제재처분들이 다수 규정되어 있으나, 이 가운데 그 처분을 내릴 수 있는 시간적 범위에 대하여 규정된 예는 많지 않다. 따라서 행정청이 뒤늦게 제재처분을 할 경우에 처분의 상대방인 사인 또는 제3자가 피해를 입게 되는 문제점이 지적되었고, 몇몇 법률상의 금전적 또는 비금전적 제재처분에 대해서는 시효ㆍ제척기간을 두기 시작하였다. 그러나 아직 국내에서는 이러한 제재처분의 시효ㆍ제척기간에 대하여 「행정절차법」에서 일괄하여 규정하지 않고 있으며, 학계에서도 제척기간의 법적 성격, 내용 등에 관하여 연구가 진행된 바가 많지 않은 것으로 보인다. 한편 외국의 입법례로는 독일연방 「행정절차법」과 네덜란드 「일반행정법전」에서 시효ㆍ제척기간에 대한 규정을 두고 있는 등 일반행정절차법제에서 제재처분에 대한 제척기간을 두는 것도 검토할 여지가 있다. 이때 제재처분의 법적 성격뿐만 아니라, 그 종류, 성격 등에 따라서 기산점 설정 등의 문제가 있고, 행정청이 처분절차에 착수한 때부터의 기간의 별도 설정여부도 남아 있다. ‘통합일반행정법전’ 내지 ‘행정기본법’제정을 통한 해결에 앞서서 제재처분과 그 제척기간에 대한 연구가 추가적인 연구가 필요하다고 본다.
Abstract
In korean Law, various forms of administrative sanctions have been legalized, though there are only a few of Acts which have period of exclusion. Therefore risk of belated administrative sanctions is still remained as problem of korean administrative procedure and potential threat to civilians. Period of exclusion for administrative sanctions has not be ruled by korean Administrative Procedure Act, but specific Statutes. And problem of this matter has not been fully identified. Whereas german federal Administrative Procedures Act and dutch General Administrative Law Act have period of exclusion-provision for administrative sanctions. So those could be model of korean legislation revision. Even if article for period of exclusion will be inserted in text of korean Administrative Procedure Act, problems of its character and starting point of period be left. By additional studies, this matter will be investigated, confirmed and resolved thoroughly.
