분쟁해결기구로서의 국가연락사무소(NCP)의기능과 역할

The aim of this paper is to review the role of the National Contact Points (NCPs), which are agencies established by adhering governments to promote and implement the OECD Guidelines for Multilateral Enterprises, in Specific Instances Procedures. NCPs are mandated to offer a good office or mediation to interested parties for resolving issues arising from the OECD Guidelines. There have been significant improvements in the handling of specific instances by NCPs but this paper argues that we have a long way to go for making current procedures better. OECD Procedure Guidance provides rules and principles for adhering countries to follow but it also allows them to have flexibility and discretion in handling specific instances. The NCP Specific Instances Procedures continue to evolve into more effective dispute settlement mechanism through OECD Peer Review Process. The NCP may learn from other NCPs and develop further its own procedure in handling specific instances by exchanging best practices and relevant information. As the volume of international investment grows and multinational corporations take more active role abroad, the spotlight will be shed more on NCP as dispute settlement body. Korean NCP is expecting for OECD Peer Review in 2019 so previous reports on other NCPs would be very helpful for Korean NCP to improve current system and procedure.
