한국 제약 기업의 국제 특허 활동 고찰: 기업 규모별 비교를 중심으로
An Examination of International Patenting of Korean Pharmaceutical Firms: Focusing on Firm Size

최근 국제화 발판을 마련하고 있는 한국 제약 기업의 국제 경영 활동을 자세히 파악하는 연구가 부족하다. 제약 기업에게 중요한 국제 경영 활동 중 하나는 해외에서 특허를 통한 혁신의 법적 보호이기에 본 연구는 한국 제약 기업들의 1985년부터 2013년까지의 국제 특허 활동을 특허 출원의 양적 추세, 출원 국가, 출원 특허의 기술 파급도로 나누고 기업 규모에 따른 이들의 차이를 분석한다. 분석 결과는 크게 세 가지이다. 먼저, 한국 제약 기업들은 지속적으로 국제 특허 출원 수를 늘리고 있는데 중소제약사들은 자원 제약으로 인해 2000년 이후부터 PCT 출원 특허들 중 선별한 것들만 국제 심사 신청을 하고 있다. 둘째, 2007년 이후 중소제약사들의 국제 특허 출원은 자원 부족과 해외 시장에 대한 부족한 지식 때문에 미국, 일본, 유럽연합, 중국에 편중되어 있다. 마지막으로 한국 제약 기업들의 미국 등록 특허를 대상으로 분석한 결과 제약 중견·대기업들은 미국 특허의 양적 팽창에선 성공을 거두고 있지만, 질적으론 아직 미흡하며 중소제약사들은 한정된 자원에도 불구하고 점진적으로 증가하는 미국 특허 성과를 보인다. 본 연구의 결과들은 한국 제약 기업의 국제 특허 활동의 이해에 있어 기업 규모에 따른 자원과 해외 시장에 대한 지식 차이를 고려하는 것이 중요함을 시사한다. 이를 바탕으로 본 연구는 한국 중소 제약기업들의 국제 특허 활동을 도울 수 있는 정책의 필요성을 제안한다.
Abstract
There has been little understanding of international business activities of Korean pharmaceutical firms that have established a foothold for internationalization. Because the internationally legal protection of technical knowledge is important to internationalizing pharmaceutical firms, this study examines their international patenting according to firm size from 1985 to 2013. The results are threefold. First, Korean pharmaceutical firms have continuously increase international patent applications. SMEs have not applied all PCT patents for international examination due to resource constraints after 2000. Second, SMEs’ international patent applications are concentrated in a few countries because of the lack of resources and knowledge about foreign markets. Finally, large firms have succeeded in securing quantitatively US patents but been relatively poor in creating influential ones. SMEs show the gradually increasing quality as well as quantity of US patents. Based on the results, we suggest the need for policies to support effective international patenting of Korean pharmaceutical SMEs.
