사이버 영역에서의 국제법상 상당주의 원칙의 적용에 관한 고찰

Nowadays, the term ‘cyber attack’ is used frequently in mass media, and it has been familiar to the general people, which means that the danger of cyber threat such as cyber attack has increased. Accordingly, discussion about the suppression of these kind of cyber threat, in other words, about universal criterion at international community to regulate cyberspace and its activities continues. When considering the discussions in the UNGGE that have made up to the fifth, it seems that countries around the world agree that the existing international law should be applied to activities in cyberspace. This study is built on taking note of this fact. Paying attention to the fact that the most cyber attacks against enemies are being made through third country, the main purpose of this study is to examine international obligations under the international law focusing on the application of due diligence principle. In this study, I tried to examine what the due diligence principle in the international law area and how to apply it to cyberspace. By extension this research is to analyze limitations and problems that can be found of above mentioned process due to characteristics that cyber space has and present solutions for the problems at the same time.
