기후변화와 농업재해, 보상제도의 필요성

기후변화로 인한 자연재해가 늘어나면서 농업에 대한 피해도 점점 커지고 있다. 우리나라는 자연재해에 의한 농업의 피해를 위한 제도가 몇 가지 있다. 농업재해대책법을 통한 각종 지원제도가 대표적이다. 그러나 이 제도는 다른 법에서도 보장되는 자연재해에 따른 긴급구호의 수준에서 크게 벗어나지 않는다. 그 외에 정부는 농업재해보험을 통해 재산상의 손실을 보전하기 위한 정책을 시행하고 있다. 그러나 이 보험 역시 정부의 통제 하에 있고 보험상품이 다양하지도 않으며 보상 품목이나 수준도 제한적이다. 정부가 보험료를 지원하고 있지만 보험에 가입하는 농민들은 그다지 늘어나지 않아 제도 자체의 실효성마저 불투명하다. 물론 많은 나라에서 자연재해로 인한 농업피해를 보험제도를 이용하여 해결하고 있다. 그러나 다른 나라와 우리나라는 농업 현실에서 크게 차이가 난다. 우선 우리나라는 농민들이 농지나 농산물 가격 등 자신들의 재산에 대한 권리가 농업이라는 이유만으로 제한을 받고 있다. 즉, 식량생산이라는 공공적 성격으로 인해 농업 자체가 제한을 받는 것이다. 이런 재산권의 제한이 있음에도 불구하고 이에 따른 보상도 보장되지 않는다. 소비자물가를 위험하게 할 수 있다는 이유 때문이다. 다른 산업분야에서는 자연 재해 등의 불가항력으로 인한 손해에 대해 국가가 보상하거나 자신들의 생산물 가격에 그 손해액을 보전할 수 있도록 보장된 제도들이 있지만 농업분야에는 이런 제도도 마련되어 있지 않다. 농업의 공공적 가치로 인하여 재산권 행사에 일정한 제한을 당연시 함에도 불구하고 불가항력으로 인한 손해, 즉, 자연재해로 인한 손해에 대해서는 보전할 방법이 제대로 마련되어 있지 않은 것이다. 농업소득이 적절히 보장되지 않는 상황에서 자연재해로 인한 손해에 대해 소득을 보장받을 방법이 제도적으로 보장되어야 한다. 미국에서의 재해에 대한 지원제도는 시사하는 바가 크다. 우리나라도 이와 같은 손해보전제도를 통해 자연재해로 인한 손해를 보전하여 농업의 지속가능성을 보장하여야 할 것이다.
Abstract
As natural disasters, the result of climate change increase agricultural disasters are getting larger and larger. In our country, there are several systems for reducing the damage of disasters, such as support systems under 'the Agricultural Disaster Support Act'. It seems shortly helpful because these are the same as other rescue system. Government encourages farmers to contract agricultural insure program for their loss. However, it isn't much demand for that because eligibility is restricted to particular crops and program is not various. In many countries, agricultural insure program is the main program for agricultural disasters and it works well because other agricultural support program is well designed. On the other hand, we are not. We don't guarantee the farmers' property rights. They cannot use the land other than farming. They cannot earn proper agricultural products price. Public needs for food is prior to farmers' right. Consumer price is prior to farmers' income. There is no way to compensate their economic loss caused by natural disasters in agriculture sector while there are several ways in other industrial sector. Public value of agriculture causes the restrictions of farmers' property right of land and procduct, etc.. "Disaster Assist Program" in the US has great implications for us. It guarantees farmers revenue if they damaged by natural disaster. We have to introduce this program for compensating farmers loss and enabling next year's farming.
