한중 환경보호법제의 체계 비교 연구 - 대기환경법제를 중심으로

초록
오늘날 날로 심각해지는 대기환경오염은 한 지역, 한 국가에 한정되는 문제가 아니라 지구 전체에 걸쳐서 영향을 미치는 인류와 모든 생명체의 생활환경과 생존을 위협하는 문제이다. 대기오염으로 인한 환경문제는 깨끗한 공기를 자유롭게 흡입할 권리를 박탈하는 가장 근원적이고 필수적인 인류의 생존권을 위협하는 것이다. 한국은 <헌법> 제35조를 통하여 ‘환경권(環境權)’을 국민의 기본권의 하나로 보장하고, 대기환경 등 환경법제를 완비하려는 노력을 해왔다. 중국의 환경법제는 그 동안 선(先)개발과 선(先)성장의 경제논리에 밀려 상당 부분 미비한 부분이 많았다. 그러나 최근 일련의 환경입법을 통하여 대기환경법제의 정비에 적극적으로 나서고 있고, 그 입법적 성과도 상당부분 성공적으로 평가되어 진다. 한국과 중국 모두 일상생활과 건강에 지대한 영향을 미치는 대기환경오염의 심각성은 같이 인식하고 있다. 그러나 한중(韓中)의 국내 상황과 입장의 차이로 대기환경입법의 간극(間隙)이 상당 부분 나타나고 있고, 때로는 지향하는 정부의 정책방향도 일정 부분 차이가 있는 것이 현실이다. 한국과 중국의 대기환경오염 해결을 위한 협력을 위해서는 대기환경오염의 심각성과 해결의 필요성에 대하여 인식을 같이 한다는 전제하에 상호간의 입법과 정책의 공통점과 차이점을 잘 이해하려는 노력에서 출발하여야 한다. 본 논문에서는 최근 그 심각성이 더해가는 대기오염의 현황과 문제점을 살펴보고, 한국과 중국의 환경법규에서 대기오염과 관련된 법제도의 비교 분석과 대기오염에 대한 대비책을 고찰함으로써 한국과 중국의 상호 협력 방안과 해결책을 모색하고자 한다.
Abstract
The ever-aggravating air pollution is not an issue limited to one region or one country but threatens the ecology and the survival of humanity and all living species. The environmental problems arising from air pollution deprive the right to freely inhale fresh air and threaten mankind's most essential right to live. Korea has guaranteed 'environmental rights (環境權)’ as one of the basic rights of the people through Article 35 of the Constitution and strived to establish an environmental protection law system. There are many weak points in the Chinese environmental protection law system since it has fell behind the economic logic of prioritizing development and growth. However, recently, China is actively organizing the air pollution law system through a series of environmental legislations and the legislations are evaluated to be successful. Both Korea and China are well aware of the seriousness of air pollution which significantly influence daily life and health. However, due to the different domestic situations and standpoints between the two countries, there is a significant difference between the air pollution legislations and the governmental policy directions are somewhat different. In order for the cooperation to resolve the air pollution in Korea and China, under the premise that the awareness of the seriousness of air pollution and the necessity to resolve it is the same, the beginning should be the efforts to understand the common points and the differences in mutual legislations and policies. This study aimed to seek the mutual cooperation measures and solutions by examining the current situation of the ever-worsening air pollution and considering the comparative analysis of the legal systems related to air pollution in the environmental legislations of Korea and China and the preparations for air pollution.
