개인파산 및 회생경험에 관한 현상학적 연구

초록
본 연구는 개인파산 및 개인회생 현상에 관한 현상학적 연구이다. 다각적인 자료와 5명의 심층면접을 통해 자료를 수집하였다. 주요한 연구결과로는 첫째, 개인파산(회생)자의 사태를 분석한 결과 채무의 주된 요인은 생계비와 의료비 그리고 신용카드사용과 사업대출인 것으로 나왔다. 그리고 이는 IMF 외환위기의 여정위에 놓여 있는 현상이었다. 둘째, 파산(회생)자는 현존재를 ‘파산자인 나’로 규정함으로서 사회적 낙인보다는 자신의 존재를 부정하는 수치심에 시달리는 것이 관찰되었다. 셋째, 원 가족이 아닌 현 가족은 파산(회생)자가 재기할 수 있는 동인이며 자조모임을 통해 연대를 형성하고 있었다. 넷째, 파산제도에 대한 주관적 인식은 ‘복지시스템이면서 자살방지 시스템’으로 해석하고 있어 제도를 자신의 금융계획의 도구로 보기보다는 경제활동 재기의 발판으로 삼는 전략을 사용하고 있었다. 이에 본 연구는 파산(회생)자에 대한 자살방지를 위한 임상적 개입, 그리고 가족과 자조모임지원을 통한 계층옹호를 제안한다. 더불어 채권추심 과정에 대한 제도개선의 사회복지적 정책개입을 제안한다.
Abstract
Using phenomenological methodology, this paper was undertaken to investigate holistic-understanding on the phenomenon of personal bankruptcy and individual rehabilitation. This paper is based on multiple data and in-depth interview method with five individuals who file for personal bankruptcy. Main research results are as follows. First, analysing situation, the result indicates that the major factors affecting personal bankruptcy involve cost of living, medical expenses, credit card debts and loan debts. These can be resulted from IMF. Second, the person who experience personal bankruptcy(rehabilitation) suffered from not social stigma but shame because they self-identity dasein as a bankruptcy(rehabilitation). Third, present family of them was an initiatives for re-start and formed a solidarity among self-help groups. Lastly, subjective perception on the policy for bankruptcy(rehabilitation) was welfare system and suicide prevention. In this context, this paper suggests that family intervention and class advocacy for them. Moreover this study proposes that social welfare policy involve to debt collection process.
