일본형법상 성범죄 관련 규정의 개정내용 검토 -개정경과 과정을 중심으로-

초록
성범죄는 한 인간의 인생을 망칠 수 있어 생명을 침해하는 범죄 다음으로 아주 중대한 범죄라 할 수 있다. 성범죄는 인류의 시작과 함께 했다고 해도 과언이 아닐 정도로 수 없이 발생하고 있으며, 각 국가들도 이에 대한 행위를 중한 행위로 보고 무거운 형벌을 부과하고 있다. 우리나라 또한 2012년 성범죄와 관련된 규정을 신설 및 개정하고 성범죄의 예방을 위하여 지속적으로 노력하고 있다. 일본 또한 2017년 3월 7일 국무회의 의결을 거쳐 ‘형법의 일부를 개정하는 법률안이 국회에 제출되었고 동년 6월 23일 공포, 7월 13일부터 시행되고 있다. 개정법안은 일본의 형법제정 이후 110년 만에 성범죄에 관련된 제반 규정을 크게 개정한 것으로 주된 내용은 강간죄 구성요건의 개정 및 죄명의 변경(강제성교등죄), 법정형의 인상, 감호자의 영향력으로 인한 음란행위 등의 처벌규정 신설, 강도강간죄 구성요건의 개정, 강간죄 등의 비친고죄화 등이다. 또한 일본은 개정과 동시에 법규정의 명칭을 바꾸고 행위의 태양을 확장하는 등 성범죄와 관련한 대대적 개정이 있었다. 일본은 성관련 범죄를 사회적 법익의 범주에서 다루고 있다. 성범죄는 개인의 법익 뿐만 아니라 우리 사회의 질서를 어지럽히는 범죄로 보아야 한다는 일본 형법학의 견해가 담겨 있는 것이다. 이러한 양국의 노력에도 불구하고 성범죄는 연일 발생하고 있어 방지에 대한 대책은 앞으로도 지속적으로 이루어져야 할 것이다. 이에 본 논문은 일본의 성범죄 관련 규정의 개정과 관련하여 개정법안이 제출된 경위 및 개정내용을 비교·검토하여 보고 향후 우리 형법의 개정시 이러한 일본의 개정내용을 참고하여 성범죄의 적극적 예방책에 도움이 되었으면 한다.
Abstract
Sexual assault is the second most serious crime after a life - one that can ruin a person's life. Sexual assault is almost as well carried out with the start of mankind, and countries are imposing heavy penalties on them for their actions. Korea is also constantly striving to establish and revise regulations concerning sexual crimes in 2012 and to prevent such crimes. Japan also submitted a bill to the National Assembly to amend the part of the Criminal Code after it was approved by the Cabinet on March 7, 2017, and it was enacted on June 23 and July 13. The amendment bill is a major amendment to the provisions related to sex crimes in Japan 110 years after the enactment of the Criminal Act. The main contents are revision of constitutional requirements for rape, change of crime’name, increase of statutory form, creation of punishment such as impurity act due to the influence of detainee, abolishment of offense subject to complaint. Japan also had a major revision regarding sexual crimes, including the renaming of legal regulations and expanding the solar of acts. Japan deals with sex-related crimes in the category of social laws. The Japanese criminal law says sex crimes are not just seen as a crime that disturbs the laws of individuals, but also the order of society. Despite these efforts, sexual crimes are occurring day after day, and measures to prevent them should be taken continuously. Therefore, this paper compares and reviews the details of amendments made to the revised Act concerning revisions of the Regulation on Sexual Crime in Japan, and references to the revision of the Act to the provisions of the Criminal Law that have helped us to prevent such a violation in the future.
